Why does it seem like one of the seat backs(driver's) has been pryed or left slightly open?

It is quite a steep price. But, considering the condition, I don't know.

Actually reminds me of that 300SDL for 19K dollars with 118K miles not too long ago. Remember perfect300sdl.com?
