Yes. As of September 2006, on-highway diesel fuel sold at retail locations in the United States is ULSD.

Their pump says its illegal in 07+ vehicles because their storage/lines/pump system has not yet been certified as ULSD compliant. Its a good reason to avoid that station as it means they are too lazy/cheap to get their tanks cleaned and equipment up to date to get certified.
