Unfortunately, the statistics that Sen. Sessions cites in the quote is a bit misleading in that it suggests that claimants do better in arbitration than in civil courts. As pointed out in the committee hearing, a claimant that gets a $100 or $1000 award is considered to have "won" versus a civil claimant that may obtain a much higher judgment. Those darn statistics.
