I've always checked my cars in park, just cause I don't like standing in front of a running car to begin with, never mind without the park pawl and parking brake firmly engaged.
Nothing is more terrifying than being outside your car when it starts to move, and you are the driver.
If your tranny is really overfilled, you can either slip a thin (think fishtank air) hose down the dipstick tube and pump/siphon some out, or I suppose you could pop off the tranny cooler line where it goes into the radiator.
