Again, the liability here may rest with Pelican, which is tolerating this stuff to be sold here, even if it's by neglect. I don't know why anyone would endanger someone else's business in this manner. These boards are entertaining and occasionally helpful, it's shameful to return the favor by endangering the host. If you want to do this business, go set up your own site.

As for suggestions that things are different now, EPA still prosecutes at about the same rate as always:

Go through these cases. You'll find VW for sure, but most of them are small time operators. They probably go after the small businesses because it's easier.

And finally, it's worth pointing out that if the manufacturer is located in one of the 13 states that incorporate CARB rules by compact, or sells into any of those states, then they would be liable to prosecution by California regulators as well. I just don't get why anyone would think this is ok.
