Yeah the fluid level was right up where it should be (I added some and then tested it) and it made no difference....

As for the seal, I think I can safely assume the rear shaft seal as the fluid is all over both sides of the back of the transmission, as well as coating the entire drivers side underbody of the car!!! That would mean the shaft is flinging it as it spins clockwise in drive, meaning that fluid would be flung along the driver side of the car, which it is.....we'll do the fluid/filters/trans-X shortly, hopefully that will make a difference.
