Is it legal to burn WVO in my car ??

Hello Everyone

Wonderfull news in Texas.
Running WVO is legal and tax exempt !!

Following in the footsteps of Illinois, Rhode Island, North Carolina
and Indiana, in the United States.
And several countries around the globe.
The state of Texas has passed laws that make the use of WVO in
motorvehicles legal !!

Thank you for your question concerning vegetable oil and biodiesel.

Texas Tax Code Section 162.001(7) defines "Biodiesel fuel" as any motor fuel
or mixture of motor fuels that is derived wholly or partly from agricultural
products, vegetable oils, recycled greases, or animal fats, or the wastes of
those products or fats and is advertised, offered for sale, suitable for
use, or used as a motor fuel in an internal combustion engine. We do not
differentiate between waste vegetable oil and biodiesel because vegetable
oil is included in our definition of biodiesel.

Biodiesel product that is marketed, advertised, offered for sale, capable of
propelling a diesel motor, or meets the requirements of ASTM D 6751 is
considered diesel fuel and subject to the state motor fuels tax code,
licensing, storage tank and invoice labeling, or record keeping
requirements.

The key to identifying whether a Texas motor fuels license is required
depends on if the biodiesel or biodiesel blend is used to propel your own
personal vehicles, sold to end users, or sold for resale.

Since you are producing the pure biodiesel (B100) for use in your own
vehicle or selling the biodiesel fuel directly into the fuel supply tank of
a motor vehicle, a Texas motor fuels license is not required. However, if
you decide to blend your biodiesel with petroleum diesel fuel or sell your
pure biodiesel or biodiesel blend to your customers for resale, a motor
fuels license is required.

Texas Tax Code Section 162.204(a)(9) exempts the volume of water, fuel
ethanol, biodiesel, or mixtures thereof that are blended together with
taxable diesel fuel when the finished product sold or used is clearly
identified on the retail pump, storage tank, and sales invoice as a
combination of diesel fuel and water, fuel ethanol, biodiesel, or mixtures
thereof. Even though the volume of biodiesel is exempt, there is specific
labeling or recordkeeping requirements even if a Texas motor fuels license
may or may not be required. If you produce pure biodiesel or B100 for sale,
currently, there is no Texas motor fuels tax.

Comptroller Rule 3.443 requires that a notice be posted in a conspicuous
location on each storage tank and retail pump from which biodiesel or
biodiesel-blended product is stored or sold to the ultimate consumer.

The notice on each storage tank must identify the product by the common
industry name or commercial name of the blended product (e.g. B-100, B-20,
etc), state the percentage (rounded to the nearest tenth of one percent) of
the finished blended product that is biodiesel, and state the percentage
(rounded to the nearest tenth percent of one percent) of the finished
blended product that is taxable diesel fuel.

In conclusion, no Texas motor fuels tax license is required because the pure
biodiesel is used in your own vehicles or dispensed directly into your
customer's fuel supply tanks. Currently, there is no state motor fuels tax
on pure biodiesel fuel or B100. The only requirement is that you label your
pump(s) and storage tank(s) to identify the contents as B100.

Thanks for posting the contents. I find it quite interesting that Texas has made a whole group of products which it lumps together under the definition of "biodiesel". At least, Texas is doing something to clarify the situation for you folks. Sounds good.

Did you know biodiesel is "tax free" in Tennessee? The definition here though differs.

Here is a link to a site I found that tells about he laws about using biodiesel and veggie oil if the state has law about it. Most states apparently don't have laws about it.

A particular state may exempt a fuel or never have had a tax on transportation fuel....but they have no say on the Federal Tax. The Federal Gov. has not exempted anything as far as I have know. They still want their cut..........

Particular states can make it legal, but federal and EPA laws say no overall.

Example: Denver has passed laws basically making very small amounts of pot in possession of adults legal. Federal drug laws still make it a crime to posses any without a medical prescription.

Prescription or no, it's still illegal under federal drug laws.....

But drink as much as you want - you can poison your liver for no medical purpose and the Feds will thank you for the revenue!!!

It may be legal to burn it your car everywhere as long as you don't drive it on a public road.

I know that here in Canada, if you make your own biodiesel , you don't have to pay road tax, but they don't include WVO, so if you use that, they want their cut.

I was dumb enough to ask my government if they would give me a grant to help pay to convert my car to WVO. They will give you a grant if you convert to propane or Natural Gas, so while WVO may have higher emissions, it is at least renewable.

They said no way, and if you do, you owe us tax.

And we signed the Kyoto accord.

i doubt any black and white could tell the diffrence between diesel, or even biodiesel to wvo.

pay tax due on any fuels used. Not excluding WVO.

Notice the carefull wording to include many types of fuel.
Again WVO is not excluded.
