Any risk in bodyshop tech working on his own
in the shop but separately from the shop. Should I have anything in writing or does that not make sense.

So, you are in the same building? Can you see other people from where you work? If so, that's how it works. Many shops are flat rate, and it's one guy to a car. Two guys trying to fix the same car only works with a case of beer and a shade tree.

What I mean is the tech wants to do it on his own probably without the owners knowledge and take the full amount or maybe he is just saying that to make me think I am getting a deal. He is offering a lower price and I have a better feeling about him than the rest of the techs I saw.

I've had good luck doing this in the past, sort of an "under the table" kind of thing. I got some motorcycle parts with the best body paint work I've ever seen for a really good price.

If a tech wants to work on a customers vehicle on his own time in his own shop that's alright. (EPA regs may stop him) if he's doing it in his owners shop the owner is going to want a cut if he's aware. Just make sure that this guy isn't already a hack.

There's lots of guys there that hack up a job in the first stages but finish well on the end and it looks awesome till the first rain and dry cycle and then the rust starts popping...
