Are those the stock tires? Stock rims? Look a bit on the low profile side for stock. Good luck...

It dosent matter what type of construction, they are damaged! Any wheel that hits that pot hole would have damage.

Nice Tag Heuer Viesel. I guess rim quality has gone down over the years; here is a proper diesel rim after 22 years of service... My Tag has 12 years of service....

If they were test driving the car and damaged it, they are responsible. In business law it's called a bailment. Get a Lawyer, they have a responsibility. They should not have been driving the car through large potholes with 19" rims. Don't let them tell you they don't know either, they are a car repair place.
Tell us more details please.

The dealer insisted on me coming in and taking them out to do the test drive. I refused many times and told them I already have test driven with them numerous times, until MB corporate in NJ called me yesterday and told me to just go in and drive with them again. I told them this will be the last time I will go in to show them again what is happening with the car. So when I got there this morning they insisted on me driving while they watch the computer. Go here, turn there, go down this street, keep it in third, and punch it, turn here, and go back, and floor it, just over the slight hill was 3 massive pot holes. Yes I was driving and doing exactly what they wated me to do! I feel if I didnt have to go in again and show them what was wrong then all this would never have happend. These roads in that area are roads that the airport will be taking over in the future, so the city has not done any work on for ages. They are really bad. I blame the dealer, I did what they said.

My 2 cents... Beter the rim than the suspension. I think I'll keep my stock size tires. (wifes car anyway)

Maybe they had this happen before and that is why they
now want the owner to drive so they can pass the responsibility to the him. Eventhough the testdriven area was as to their instuctions, you where driving. And that is what they will use against you. They'll say "It's our fault, you where driving not our tech". It sucks but they're not going to take responsibility for this, eventough they should. If they had halfway decent techs then a diagnosis wouldn't require multiple roadtests. You could report them to your local better business bureau. Citing incompetance and poor customer service, but how much good that will do is to be seen. You can also inform your local tv station, and if you can get them interested in your story they might have some impact on how this dealership reacts. I on the other hand would go further but since I don't know how far one can go before some action becomes slander, one has to be carefull. I know in Belgium you can easily post this dealerships incompetance ,poor service and immoral behavior in the local newspapers for all to see, here in the US I don't know if this is at all possible without getting yourself in trouble. I hope you get some resolution. Louis. |

NAH, no one is gonna buy it. I don't buy it, no way, YOU were driving it, it's not like THEY were driving it. Sorry to be abrasive about it. Accept responsibility. Anyone else with feelings about this? This is JUST what I thought probably happened. HA!
If they don't have any DTC's, and can't find the source of the problem after numerous attempts, they should call in a MB service technician, one of the regional "tech coordinators" as they call them. "Someone from Mercedes" in other words. Insist on it. Gilly

Answer:
YOU were driving; any judge will not accept other evidence.
If you consider the situation a hazard, it is your sole responsibility to avoid damage and danger.

I agree with the "you were driving crowd" as far as the rims. To add to this, it's only common sense to not have 19 inch non-OE rims and super low profile tires and expect them to hold up to large pot holes. Those rims and tires look like they are made for the track, not a pothole filled street. I get what looks like the same thing as a mechanic in large sportfishing yachts- up to 30% of the "problems" we fix are due to what we call OE- operator error. Can't ask the equipment to due what it's not designed to do- regardless of cost. Can't operate the equipment properly if you don't know what it's limitations are. The best one I had was a complaint that the sink would not drain. Came on the boat with a filled galley sink. Checked the plumbing visually, checked the sink visually, and then reached down and pulled out the rubber stopper.....
Your other problems with the CDI I cannot comment on, and really I can only judge by the photo's I viewed, which is not real idea of what happened. |
