What does he mean he's not the seller and not responsible.....it was his Ebay Id..its was his listing....therefore he bears the responsibility. Somethng he should have thought about. "Selling this for a buddy" doesn't get him off the hook.

Regardless, now I'm "unethical" and "pathological"

Bmwskunkworks (the eBay user) is really going ape-wild in his negative retaliatory feedback. I think his nonsense qualifies for feedback removal by eBay, so I've filed for it. He even went as far as to say I called him to say how pleased I was with the car. WTF? I called him to track down his deadbeat friend. The humor continues...

But in the end, Fair Market Value has to be attached to your value. If you like the car, then it has fair value no matter what the cost. How does one get qualified to post KBB numbers? I'd bet an insurance company owns KBB! I wonder what would be the KBB fair market value on a new set of 16x225 Michelins MXV Plus along with the rims? $3000.00 FMV for that car?

I'm never in a hurry to leave negative feedback, but I'd certainly be willing to leave it if I thought that I had exhausted all reasonable means of working things out with the other party. In my personal experience, it's never come to that, but that day may come. It's the option I'd exercise "when diplomacy fails".

I don't see anything overly harsh in what thelazzarusman left for the guy, either. I'd keep it straightforward, factual, and impersonal - exactly as he did.

A neg received in retaliation for a well-deserved neg? Wear it with pride!

Lazzz if I wear you I'd pile on the negative feedback-issue onto your lawsuit!

Basically, the seller has responded in RETALIATORY fashion and has liabled your EBAY account.

That is worth something. It may count in court because EBAY is electronic commerce.

If you lay outt your case and can show that the seller has smeared you with false and slanderous neg feedback that ruins your EBAY status for future business, then you have one more fact that underscores the sellers bad faith.
He sells bad product, tampers with odometer (have it checked by an instrument specialist) and slanders.

In court cases, the more you pile on, the better it works for you.



meticulously keep dates, times and NOTES.
do this as if your PHD rided on it!

success!!!!

p.s. sue the seller and the 'john doe' other party and leave it open to all and any third etc. parties.

The plot REALLY thickens!

Well, the seller has hired an eBay mediator. The only thing is, instead of being "Chris Marino," the name the eBay ID's owner has claimed thus far, the "Safe Harbor" ID says his name is "Jack Galadjian," which is not far from "Jack Petrossian," the name of the man whose car was sold to me. Sound complicated? It gets better. Jack Galadjian is the same name as a gentleman arrested for auto insurance fraud in California, as can be seen in this link: http://www.insurancejournal.com/news/west/2003/05/23/29235.htm.

The seller was perfectly clear--offensively clear--last week that the issue was closed and that I could pretty much rot in hell. Now he's hiring a mediator. Methinks he doesn't want to appear in a courtroom (which is the direction I'm headed) because of an unsavoury past. Thoughts?

Unless he offers you a check I'd drag the SOB to court just to prove a point.

However with a mediator if you work it you will get something $$$. Problem is enforcing the judgement.

This thread is like some kind of drama!

If you go to court he is in big trouble, I dunno three strikes maybe? Is this something they will put him in jail for? Hes in deep doodoo that is for sure.
But if the mediator is made aware of this, openly in the presence of the seller, it might just get you a lot of satisfaction (out of court)!

Ebay Bandits? I would try to check background here to establish if there is any equity item to seize to satisfy a potential judgement. The old expression of getting blood out of a stone kind of still is valid. The position looks like money or court now. Better chance than the court alone perhaps. You have been in contact with the ebay organization I hope.

Agreed in some States it is not even illegal to bribe the mediator. I would never sign a deal for contract work on my house with a mediation clause written into the original contract. Plan your next vaction to coincide with your courtroom time with the seller.John

I agree avoid mediation at all costs...the results of those are usually binding and if you get the shaft you may have signed away your right to sue. Might be worth a consoltation visit with a lawyer to get proper advise. Even if it costs you something.

If it were me, I'd make sure my Lawyer was a "pit bull"
and I'd sue him in civil court and if what Russel say's is true (and I believe him) and this is a federal offense. I'd sue him in criminal court also. If my Lawyer balked at anything less I'd find another.

Not sure of your financial means, but you local law school usually takes on cases Pro Bono and has a team of law students working on it. This would be an interesting case, with all of the variables involved.

Forget Ebay and the moderator. If you want justice seek it through the courts. Tell the seller he has one last chance to make things right. After that, he will need to comunicate with you, through your lawyer.
