As long as you are

running ASTM commercial biodiesel, neither MB nor any other engine/car mfgr that requires ASTM fuel standards (they all do) can legallay void a warranty. They get away with doing so by cowing consumers with the threat. And it works, because most of us don't have the time, money or inclination to take the manufacturers to court. Their day of reckoning is called class-action lawsuit.

Its built with more environmentally friendly stuff. You know wood, and leather. Cows and trees grow back!

How does the actual mileage compare to that (using miles driven and # of gallons at fill-up)? On my ex Civic Hybrid the computer was overestimating my mileage by a few mpg.

It's difficult to directly compare the emissions of gasoline and diesel engines since their exhaust is so different in composition. The easiest thing to compare is CO2 output and there the Prius still spanks the vast majority of cars, diesel or gasoline. It gets more tricky when you compare, say HC emissions (typically high from gassers) with NOx emissions (typically high from diesels). It takes both to create smog, though some studies have shown the HC are the main culprit. Another tricky comparison is that of particulates. Diesels produce a higher quantity of them, but gassers produce more tiny ones which are potentially more harmful. Also those EPA pollution scores are misleading because the scale is in favor of gasoline emissions.

I did tell him I just got the car yesterday and I was not used to it. I mentioned that it was a diesel and the policeman mumbled "must be a turbo" . Anyway the ticket is a "soft" ticket as it will not result in any points against my license.

What is a "Soft ticket" in California, or anywhere else for that matter? Every ticket I have gotten California added points to my license and flagged my insurance policies. I finally got my "Good Driver" status back with my insurer after waaaaay too many years.

According to the policeman, this ticket is a City of Alameda ticket and he said it will not count against my license and I will not need to attend driver's school. My wife got a similar one last year and it did not go against her's either.
