Red Diesel aka Farm Fuel, Heating Oil is governed by DCO's (Diesel Compliance Officers) this is a department of the IRS. However the IRS has given (paid) some state agencies to enforce for them.
When field testing is done on fuel in a vehicle or storage tank it's a violation if the fuel contains more than 8 parts per million of red dye. The sample is sent to the Air Force for precise testing. Vehicle fines are $1000 for the first offense and $2000 for the second offense and moves quickly into big numbers after that. If you have bulk fuel storage that is being used (proven) the fine is $100 per gallon with a minimum of $10K for first offense. Worthy of mention. If you throw discarded red ATF in your tank it will get you busted - they don't test for composition, just for dye.
