it is fine. he can believe what ever wants. he s only hurting his self by bashing a person he does not even know. there will be a time when he needs help and people will refuse to give it to him. i think he should just be booted, but hey according to him i am a liar.

and he is right about the witness thing. he must have been there the way he is talking. he is all knowing and all powerful. i might only be 24 but i have manners.

As far as proving fault. If you have photos of the vehicles before being moved, there might be enough evidence from glass etc. ejected during the impact. It looks like it was probably about a 5mph impact, possibly enough to knock the car backwards a few feet? High-res photgraphs at the scene might show the story, might not, and even that depends on whether you can get an audience from your state's forensics lab. Basically chances are grim.

The dive & height issues might show that you weren't decelerating during the impact, ... but it could be argued that your foot slipped off of the brake or you didn't brake causing the height match. Not a valid angle if I were the other driver's attorney.

The other issue that comes up is the cost vs benefit. If you are in a no-fault state, you have to look at your deductible and coverage. If you have substantial money to gain and can wait for the decision, go for it. If not, might be time to take your lumps. When I was young I went to an attorney to contest my insurance company's payment for an accident, the attorney would have taken as much money as I had hoped to gain, ...
How would I know?

I know he slammed into an old man's truck from behind. He claims the truck's rear end jumped out and hit him at 25 mph........riiiiiiiiight. How the old man's new truck did it is anybody's guess.....the law already wrote him up in a report, and he's going to pay. He is guilty of following too closely. The police already told him that he's guilty......case closed........

Just how do you explain the front of your totaled SD?

How fast were you driving in reverse, when this old man's truck totaled your front end???

This old man's new truck just magically started toward the front of your car @ 25 mph? Riiiiiiiiiight...........

You have a beautiful W116 there, I would most definatley fix it! Keep it alive! Overall thats minor repairs. It needs a hood/grill, and maybe a radiator/oil cooler. And the headlight assemblies. Totally fixable....probably even yourself!

Not sure whats up with skid row joe....maybe he'll have someone do that to him someday, and he'll see what its like. Both my dad and I have had hit and run accidents on our cars in the past couple years. I was sideswiped on my rear passenger door by a drunk that floored it at me as I was going through an intersection, and my dad was rear ended pretty hard. Both were fixable, and in both incidents the person took off. Theres a LOT of moral-less people out there. I'm sorry it had to happen to you too. That guy will get whats coming to him someday.

Look on the bright side. Good time to get a pair of Euro headlights.
If you choose to stick with the ugly US style, there are probably lots out there from people who have done the conversion who would give them to you for the price of shipping.

I don't think your situation is all lost. You need to insist on your version, that your vehicle was stopped at the time of the collision and he was moving in reverse.
Talk to your insurance and tell them there was no other reason for him to stop his vehicle, other than to back up.
Since there are no witnesses, your word is as good as his. Insurances usually square those situatons by breaking the liability into a percentage.

One fortunate thing is that there are a lot of those cars out in junkyards with worn-out gas engines. If you're into the DIY thing, you should be able to collect most of the parts quite cheaply.

i plan on doing what it takes to bring it back alive. after replacing the engine and having the transmission rebuilt, i think i can tackle what needs to be done. and a friend of the family has his own body shop and he is the best in the area. even if they total it i will buy it back.

as far as the euro lights go... i have a set in denver in storage so i would not buy another set, unless i found them in a junkyard. i just have to find the time to go look for some 4.9 sel's that are rotting away.

i know texans say not to mess with them.... but of all the texan's i have ran into or became friends with they are all very dosile and nice people. joe is the exeption, and unfortunately the exceptions are out there.

*edit*
this will add to the bumpersticker that i am going to have made.
"this car is made of 80% recycled materials."

Man, some one really needs to ban this douche bag. He has nothing helpful to say and is only aggravating everyone on this thread.

The world is full of big men who hide behind little keyboards. Sorry to hear about your car and good luck getting her back on the road.

Are you sure that isn't little men behind big keyboards???

I'm just glad Trevor is going to fix the car no matter what. Nice W116's are too rare to discard, and are worth the effort.
I'll be glad when Dan gets mine fixed up more......
