Fraudulant seller on ebay..

Just breifly, the car was completely misrepresented, the most obvious was the extensive hail damage to the body not mentioned in the ebay description but acknowleged in the walk-around condition report the seller signed when loaded on the truck to my location.

There's much more to list, the worst claim made that the car was safe at highway speeds, (Which it wasn't.., it will barely go 50mph) but again the car was obviously wrongly advertised as signed documents clearly attest to.

What are my legal options at this point. The car came from CA. to MI. if that matters.

Any advice appreciated.

Contact the seller, lodge a complaint w/fleabay, contact a lawyer...If you paid w/a credit card, dispute the charges.

It is OK to tell us the sellers name. Just say I fell seller "X" misrepresented this car in his ad and why. No one can come back at you for slander or something like that. If you use words like "I feel" or "in my opinion" + the truth you will be OK.
Contact Ebay first. Print a copy of his ad so that you have a copy for yourself and be sure to keep any paper work involved including questions/ answers Emailed. Do the same thing with PayPal if you paid through them.
If you want to take the seller to court I believe you would have to do so where the sale was made which I believe would be considered California since that is where the item for sale was located. Courts do not like to consider a law suite until the other options like contacting Ebay and trying to resolve the problem with the seller first.

I hate to tell you, but I dout flea-bay will do anything at all. I don't know if you heard about the guy on ebay that bought a new M3 for 60k from a ebay dealer and the dealer refused to pay. They worked it out throught near courts and ebay complaint department still has not even contacted him back.... Best of luck to you!

Live and learn. I had the same thing happen to me. Good luck. The good thing is these cars are fairly easy to work on and with help from the great people on this forum, you will be able to bring it up to snuff! I did.

I decided long ago to only bid on cars within reasonable driving distance. So I could personally view the car the very next day. Even if after the auction was the only reasonable way to do so.

I am also a victim of a misrepresented car. However... all I lost was a day of my time, 260 mile round trip and a retaliatory negative on eBay from the seller when I walked away from the deal due to his misrepresenting the car.

my first car was also an ebay purchase. but my experience with these cars was not enough that even though I picked it up I still missed a lot of obvious things. hopefully you got a starter car for a starter price. Fix it to suit or to sell and get a better one next time with all you learn on this one. experience always comes at a price. the only thing you can hope for is that the price goes down with age

In the future & for anybody else reading this there are plenty of people on this forum who will go out and look at a car if there is a request to do so. I have done it myself.
Don't buy before someone has a chance to look at it.

We're in the innitial dispute stage on paypal now but I'm not sure they will be much help. My CC company may be able to help, they have in the past.

I had a reacent issue with a car dealer on ebay, or someone who claimed he was. From what I see as far as the ebay motors part of ebay, the rules seem to be made for people to easily get away with fraud like this.

The car is fairly solid and handles well but outside of that it needs major work like a new transmission and probably a motor in the not so distant future.

UMMMM, seller from CA that misrepresents his cars???? sound like we have heard this one before.
