Adsit

I used their e-mail remove function and added the reason I wanted my name removed from their list...
I told them I refused to do business with any company that did not think good customer service and treating their customers with respect and dignity were the most important facets of business in general and on-line business in particular.

Much more, I'm sure. In that situation, the Adsit approach backfired. The terms and conditions are good defense, but bad offense because they are so onerous. When I clerked for a judge here in Philly, we would definitely have figured out a way to a poor result for a company like adsit.

The decision is very interesting.

Adsit was awarded no damages at trial for the specific reason that they "lost" the goods after receipt. If Adsit (or its supplier) had not lost the goods and simply claimed that the seat covers were not able to be resold, they would have won the case. The terms of "all sales final" cover them quite well. They don't have any legal responsibility to make good on an erroneous order.

Avoid this company like the plague.

What floors me is how many people continue to purchase from them. Adsit should have been out of business YEARS ago. If the Star magazine allows them to advertise, they should refuse to accept Adsit's dirty advertising funds and make them go elsewhere.

Here is that BBB link again, for anyone who has not yet filed a complaint against them. Note that Adsit "is not a BBB Accredited Business". Gee, I wonder why?

http://indy.bbb.org/WWWRoot/Report.aspx?site=93&bbb=0382&firm=14001782

The amazing part is they have ONLY 13 complaints in the last 36 months! That means a lot of people aren't reporting their problems!

I would seriously concider filing a report here :

http://www.ripoffreport.com/default.asp

These people claim to NEVER remove a report once posted.
Of course you need to be factual and detailed about the problem .

I would suggest that the vast majority of the purchasers are OK with Adsit. The item is as advertised and it fits the vehicle.

However, when it does not is where the problems arise. They clearly state "no returns". So, if you buy from them, you take that risk. You also take the risk of shipping.........even if they ship the wrong item. Their terms are clear.

We have the option to walk.

Contradictory policy aside, it appears that the merchant has agreed to accept the return. The issue is with who pays for the return shipping. Unfortunately, the Uniform Commercial Code makes the buyer responsible for return shipping costs, without regard to the reason for return, provided that the sale was not on an approval basis.

From all indiactions, the merchant has breached the implied warranty for fitness for a particular purpose, entitling the buyer to a refund of his purchase price.
