Two '08 Bluetec Buybacks on eBay Recently

I've noticed that the second 2008 E320 Bluetec buyback car (read: LEMON LAW) listed in the past 2 weeks on ebay. That's certainly a disturbing trend.

It's interesting to see them come up for sale and I wonder why they are having such problems fixing issues that they are forced into buying the cars back (typically the law calls for at least 3 attempts to fix a problem before the manufacturer is required to take them back). Of course the sellers play down the issue and re-assure a buyer with the "remaining manufacturer's warranty will still be honored" but the fact that Mercedes had to purchase the cars back and the titles are marked as such is nothing they should be proud of.

One thing a buyer should know is that once these cars are resold the buyers no longer have any protection under the lemon law because they are now "used cars". Basically they could be stuck with a lemon that spends as much time in the shop as in their driveways and there is nothing they can do about it.

I also know that even though these are "voluntary" buybacks they basically only buyback a car when they know they would be forced to if the owner goes through the lemon-law process. Here are the two which I saw...I wonder how many more are out there?

MB buys back about 500 cars a year on "lemmon law" issues.

Some are serious issues....MOST aren't!

I think it's funny that the seller says the problems are fixed. There are reasons they send them to the auction.

The problems should be fixed. To my understanding, it's not necessarily multiple failed attempts to repair something that may make the manufacturer buy back the vehicle, but it could also happen when the repair takes too long. This could especially happen if the offending part is on back-order so it really doesn't have to be a serious issue or something that can't be fixed. But it's good to know that the lemon law only applies to new owners. I don't think I was aware of that.

The lemon law depends on the state. Here in NYS, the lemon law does apply to any and all used cars under 10 years old and with less than 100K miles. It isn't much, but it's something:

b. Written Warranty required; terms. 1. No dealer shall sell or lease a used motor vehicle to a consumer without giving the consumer a written warranty which shall at minimum apply for the following terms:

(a) If the used motor vehicle has thirty-six thousand miles or less, the warranty shall be at minimum ninety days or four thousand miles, whichever comes first.

(b) If the used motor vehicle has more than thirty-six thousand miles, but less than eighty thousand miles, the warranty shall be at minimum sixty days or three thousand miles, whichever comes first.


(c) If the used motor vehicle has eighty thousand miles or more but no more than one hundred thousand miles, the warranty shall be at a minimum thirty days or one thousand miles, whichever comes first.

Well...it doesn't matter what we think, one of them sold for just over 45K Base retail is $52900 and the dealers are giving up to $10K discounts (at least that was a few weeks ago) so whoever trow this kind of the money...could have bought him/herself a new one from the showroom floor.
Looks like there are people who don't really care about the Lemon Law.

It doesn't have to be something serious, but sometimes it is. I've been to a couple auctions where "Courtesy Buy Backs" are sold. In California the reasons have to be disclosed. It's fascinating to listen to the Auctioneer list the reasons. Sometimes it really is something as simple as multiple CEL episodes, but I've also seen brand new or nearly new cars with major Problems. Some were real jaw droppers. Major problems were fixed, but there were a few where an electrical gremlin was never completely resolved. They had to disclose that too, and usually the manufacturer would extend the warranty. I remember thinking, wow, so the new buyer gets an extended warranty then gets to experience the same joys that caused the previous owner to walk away.

I wouldn't want one. One of the reasons, is that the branded title is going to reduce my resale value too.

With all the Shenanigans

Involved with automobile auctions (And Chassis(s) repeatedly going from one
state's to another's to disguise the Defects) ...
I'm amazed any of this knowledge is allowed to escape into the consumer realm.

"CarFax" some chassis,and they've been to 5 or 6 different auctions in 2 or 3
different states in a row!

AND any Stealer ,Distributor or Manufacturer who cannot Beat/Defeat "CarFax"
ain't worth it's weight in thumb tacks.

After looking at those 320's I assumed the lemon law also applied to cars too ugly to drive. That has to be the ugliest car Mercedes has ever built. I think the Unimog looks sportier.
Regarding MB quality these past ten years; a friend of mine recently had some transmission issues with his '03 E500. The radiator was leaking coolant into his transmission cooling lines. He's hoping that he caught it in time. If not, he's looking at a $5,000.00 transmission replacement. It's kind of embarrassing to call yourself an MB lover when you hear a story like that. No, he wasn't using the green stuff.

So that is 3 in two weeks of one model...it's hard to believe they only buyback a few hundred a year when three bluetecs show up in two weeks. They must sell 50X as many gassers as diesels so statistically there have to be many more gasser buybacks unless the buyback is specific to the diesel engine itself...either way I don't think it looks too good for the '08s.

I am always amazed that the people who

would never take one of these buyback cars (and I agree) but think nothing of buying "reconditioned" computers from Dell and HP.
