Mercedes Attitude in using their logo or copying their designs
 
Mercedes Benz is real touchy with the use of their name, logos, designs and anything copy writed etc...

There has been some discussion of making NLA plastic parts with the new technology out there is plastics and Computers. wonder how this would play out if they got wind of it?

One reason Mercedesshop.com is NLA is the use of their name and the conflict of selling parts etc.... MB now ownes this Domain name.

I came across this story of a Gull Wing that was copied in Fiberglass, and confiscated and ultimately destroyed by MB.

I don't blame them, either. If I owned such a valuable trademark, name, image, lifestyle, fill in the blank as they do, I'd protect it, too.

Look at VW, they are effectively killing the air cooled resto parts business over some sillyness over using the VW logo on reproduction parts.....

This kind of thing has come up on other lists.

A trademark / copyright holder MUST defend their TM / CR every time any infringement comes up otherwise they can lose their rights. " You are letting person X use your TM there for I can to."

It can get silly, circa 2006 Sumitomo rubber / TBC tire sued drag race engine parts manufacturer Dart / Richard Maskin for their use of " BIG M " Sumitomo's claim was that people would confuse Big M engine blocks with Big O tires.

Dart did prevail and from what I recall, gave Sumitomo some John Wayne toilet paper, ( Rough, tough and doesn't take xxxx from anyone. . . .)

Actually this trend toward aggressive defense of intellectual property has been an ongoing preoccupation for many years in the corporate world, and now in government as well.

When Ford acquired Volvo, for example, they almost immediately went on an aggressive and extremely nasty campaign against parts vendors and owner forums using the V word that shocked the entire owner community (Volvo had been completely hands off).

I work in corporate employee communications, and even there I am now more restricted than I could ever have imagined with respect to the use of images. For example, I cannot take a photo of a crowd of staff at a charity event unless I have written clearance from each individual to publish their image on our internal network. Not exactly practical in a parking lot with more than 100 people present.

Our lawyers don't like the user agreement provisions of stock photo agencies either, so I can no longer use image bank photos to illustrate material.

All independant shops were ordered to remove the star from all paperwork, invoices, stamps for service books etc about 15 years ago over here.

From what I've observed, a number of companies run-for-the-hills, when threatened OR even confronted by a bully corporation. Same thing with people - some are scared of their own shadow and won't stand up to the bully. Both are kinda milque toast and pathetic in my view. ;) :laughing:

kind of a weird view when you aren't the small company blatantly using the brand name recognition of a large company and could be faced with a multi million dollar lawsuit that you would definitely lose and might put you out of business, while it would scarcely be a bump in the road for something the size of MB.

"scared of their own shadow". :rolleyes: nice. Id call it prudent business practice to immediately back away or change the obvious infringement, IE, mercedes shop immediately became peach parts as an example.

I state this in all sincerity since you've claimed the moniker as the standard bearer for the determination of who's rude and who is not. check the time stamps, this was before I busted your balls about the hansen issue. I suggest you keep OD nonsense in OD, not carry them into other parts of the forum. Same pattern as letting an OD argument with an idiot cause you to email a 3rd party like that.

Well... the tension ratcheted up a bit here. Anyway. I work for the biggest telecommunications company in america and they wouldn't let me put the logo on my business cards. They eventually bought some themselves with the logo on there. Before that I had to print my own without the logo...those looked legit :rolleyes:

Mercedes isn't the only one.

Edit: forgot to mention the point of the post.

Trademarks don’t last forever. Mercedes has been using the word MERCEDES since 1906, so we KNOW that the trademark protections of 20 years after 1906 have been exhausted. This case is over, (mercedesshop.com is owned by Daimler), but I hate to see AMERICANS get screwed by Germans, when America won the WAR. If Germany, MERCEDES will do an American like they did Mr. Wood in this situation, just imagine what Germany WOULD HAVE DONE to Americans if they had won that World War II.

It is unfortunate that Americans are so weak and don’t understand that you can never let a LOSER keeping winning when that LOSER has lost, lost big time, like losing a WORLD WAR and then they get an international group like the WIPO to keeping fighting trying to re-win that lost war.

That is the only good thing about the way Daimler took mercedesshop.com from Mr. Wood using the TRADEMARK issue in the WIPO, even though Daimler’s rights to trademark the MERCEDES name expired 20 years even before World War II started, so we know it was expired in 2001 when Daimler claimed to have trademark rights, but Daimler’s move against Mr. Wood just let Americans KNOW that we have to keep our foot in Germany’s behind, because they put their foot in Mr. Wood, even after LOSING the war PLUS basing their case on an EXPIRED trademark “MERCEDES”.

i hardly see the moral link between winning a war and protecting a trademark. if germany is a legitimate state with which we have good relations, which it is, and one of our most important trading partners, which it also is, then we need to deal with them in a sober, forward-looking manner - something better than the WIPO would be nice though!
