ML320 limp mode

I'm working on an ML320 with a Check Engine light on and goes in and out of limp mode. When it acts up it's stuck in one gear and maxes out around 40-45 mph and 4000 rpm. Customer says if he stops and moves shifter from drive to reverse and back to drive it goes back to normal. Codes in the Engine are P0700(trans fault). Codes in the Trans are 41 and 137(both CAN communication fault with transfer case module). Have already replaced the valvebody assembly and trans ECU. I need help ,any common problems with these symptoms and/or codes ?????
NOTE: one of my scanners said this was a CAN: communication fault with instument cluster, but this is an error ,it's a communication fault with the transfer case module. This is a 4WD unit and only the check engine light is on.Low range light is not flashing any errors.

Perhaps it might help ?
Clean all the Fuses / Relay connections / Battery Connections
