That is the lost amendment. It was a neat idea that died shortly after it was voted into existence. Nobody wants to devolve power, everybody wants to accumulate it. therefore, it will never important. Libertarians and states rights folks know it is there, but the rest of the country says it stinketh and they want no part thereof.

As a citizen, I have an inalienable right to pursue happiness.

Shouldn't the question be . . . What amendment says I can't?

The 18th said you couldn't get drunk, one of the few "negative" amendments, but apparently getting drunk is okay thanks to the 21st. Shouldn't there be an amendment that says no toking?

Federal law says you can't....state law says you can't.....there is no constitutional right to getting stoned....there also is no constitutional right to rob the bank...beat your neighbor to a pulp just for the hell of it.....or to fornicate with your neighbors livestock...
