Commercial leases vs Residential leases

I think I'm in love!

Compared to residential, commercial is awesome! The landlord makes all the terms, can evict the next day after not getting payment. Plus you get cool terms like a triple net, ect.

Commercial is far more complex, I am looking at a "standard" lease agreement the professor emailed me and its 53 pages long!

I can see why the big boys do all commercial, it just seems so much better dealing with business then tenants.

I guess school is good for something, I learned something very usefull!

53 pages? The standard commercial lease here is 17 pages.....

Mine is 3. When I had my building the one I used was six, and it had a lot of extra stuff in it because I rented furnished offices with telephone, answering service, copiers, ect.....

Never mind its 31 pages. According to the professor (real estate attorny) who has been doing this for 30+ years they get quite long and complex with large clients.

If anyone wants I can email it to them, its interesting.

my commercail lease is 11 pages and growing. the residential is four pages. every time i have a lease failure a paragraph gets added. 31 at present i think.

long contracts are ok but if the party signing does not do so in good faith you will still suffer.

but it is still better to have one than not.

nobody can remember what they agreed to otherwise.

Its boilerplate cddddraaaap from the days of speaking Complaints and legal sized paper used by people who are plagarists (not a bad thing in the legal profession) and don't want to put time into their own paper. Litigation is so much easier and to the point over a simply drafted contract. cya doesn't mean what it used to thanks to the UCC.

I know, and I want to stay that way.

I see very often there is a large gap between the classroom and practice. So no one uses these super long boiler plate leases anymore?

Most people use them because they are available and have already been drafted. There is a cottage industry that sells crap like that at Office Depot, online, whatever. My experience is that when you are locked into litigating your interpretation of the four corners of a contract, simpler is better.
