Yuck, need advise... Junkyard trans problems
Allright, I blew 3rd gear out of my escort last week (fooling around, VROOMMMM grind..................... **** )... Local yards want $275, I found one 2 and a half hours away for $125 with a better warente. Good deal, so I go get it... I'm crunched for time, so I was real quick in picking it up. Enough time to quick look it over, pay for it, and load it up....
So, i get home, unload it, and start to clean it up. My plan was to take my car apart today after I got back from Fort Mccoy (an hour ago). As I was cleaning it, I found something that made my stomach drop... There's a hole in the bell housing. About the size of my pinkey, on the top side of the trans. Also, the flat spot where the sticker for the serial number should be is blank... Just some stickey residue... They're closed till monday, but they seemed kinda shady. They were opperating out of an old car wash (grates in the floors covered with carpet), and didnt even have a lift... Just a forklift, and lots of jackstands/jacks... All the cars in the parking lot (compleatly crammed) had plates on them. I'm thinking they might have been a chop shop. It cost me $20 to drive down and back... I want money back... So here's my plan, I'm going to call them on monday, and go from there. If they ask me to bring it back, I'll say that I will bring it back for $75. OR if after I JB weld the hole, put it in and test it (2 weeks from now), If it checks out OK, I'll ask for $50 back... To be mailed, and be given one weeks time to recieve the check Would that be unreasonable? backup plan, if they refuse to deal with me, is to drive there, with the trans and paperwork, and go to the local police... Selling a transmission with a scraped off serial sticker cant be too legal, and I'm sure there's some illegal opperations going on. That many plated cars parked in a parking lot... Andno safetey glasses either, anywhere... Can someone give me better advise? Tks alot ~Nate

Do you think they will really send you a check?
Taking the hardass way from the get go will get you either a cap in the skull or worse.
You sound as if you have already made up your mind so just go to the cops and be done with it. If you sue 'em they won't show up and getting a judgement paid from an all cash business is tough (leased shop, no real assets, no bank accounts, etc). Of course it could all be just a simple case of an error on their part, compounded by your anger. |

An offer to accept a return is the best you will do. I would be surprised if you were offered travel expenses. I would also be surprised if the police-the local to the yard police- do anything. You don't pay their salary. Did you get a written warranty? If not be thankfull for anything you get back. If you did, you can swap in the trans and try it out.
No one is going to give you much help for a $125 junkyard trans. Personnally, I wouldn't the 2 1/2 hrs drive back to the place for a refund of the purchase price. |

yeah, I guess I should just try it. The warentee's a printout with their name on it, and it looks some what professional...
I'll call them monday and ask what they think I should do, and then go from there ~Nate

Come on man. You're 17 and have 4 cars and a motorcycle. You don't need the Escort. I don't care how great of a deal you think you got. That car was a total POS the day it drove off the lot. Suck it up, get rid of it and drive a different vehicle. There are an infinite supply of cheap cars out there - jumping on every one that comes across will not work out for you in the long run. Learn a little bit of restraint. Your mom will thank me.

Did you pay with a credit card? I am very leery of doing business with companies that do not accept credit cards.

Then you might have to take him to court to get your money back. That is why I usually try to pay with a CC. That way they go to bat for me

Call them and see what they say, never threaten anyone with anything it won't get you anywhere. You can't sue them over a $125 trans, most lawyers pay more then that for a set of shoes, they won't even talk to you. So what if you win in small claims? After paying the $50 court fee's plus your time, you won't collect a dime. If the place is really shady you may collect a beating or worse....
Call them if they tell you to buzz off chalk it up to a leason learned. Its only a $125 transmission, its probably worth damn near that in scrap these days. Far be it from me to preach on this subject, but you really should spend your hard earned money on better things. Cheap cars are just throwing it away, on well cheap cars. You have that Olds thats a nice car you should just drive that, you said it runs good and it probably gets good fuel mileage.

Yeah you do include the court costs in it, so you will fail to collect $175 insted of being out $125.
My CC is pretty good, I had a credit monitering company that kept charging me even though I told them to stop. Visa delt with it.

My dad and I bought some parts from a local junkyard on his AMEX card. We bought an SRS module, blower regulator thing, some power window switches, and some other little odds and ends.... The SRS module was faulty, called AMEX, and they were on top of it! Hmmmm..... MY dad told me always to buy anything from the junkyard with a credit card. He has dealt with a few shady characters, and has been burned more than a few times....
