Drunkest Driver Ever

http://www.thesmokinggun.com/archive/years/2008/0110084dui1.html

JANUARY 10--In what may be the most extreme drunk driving case ever, an Oregon woman was arrested last month with a .72 blood alcohol level--nine times the state's legal limit.

Comer's vehicle came to a stop about 50 feet in front of one of those portable traffic signs reminding motorists not to drink and drive

She doesn't look that bad for being as drunk as she was.

I thought that was more than required for alcohol poisoning. I'm surprised she didn't die from it!

No, I'm not quite buying this, particularly if the alcohol detection method was a breathalyser. She may have consumed alcohol, but I'll bet that her last drink was not long before the test, whereupon the residual alcohol content in her mouth would have skewed the crap out of the results.

There is about ten pages in the Intoxylizer 5000 operators manual devoted to the subject of residual mouth alcohol. They actually film the accused during the waiting period and have done so for about ten years, so the accused can't claim they took some cough medicine, or burped or puked during the waiting period.

Are you suggesting that drunken drivers would tell a story to the policeman, JD?

Used to be a big defense trick to get the cop to say he didn't observe the perp the whole time in the tank and he could have burped, which could have caused residual mouth alcohol to skew the BAC test. If that woman wasn't observed during her waiting period or they administered the test within 20 minutes of consuming a drink, she walks.

Exactly--now you become a juror who may doubt the test is accurate....
