Punishment for US tolerance of Homosexuality

A church whose members cheered a soldier's death as "punishment" for US tolerance of homosexuality has been told to pay $10.9m (£5.2m) in damages.

Unless there is something more to the story than is printed, I fail to see how the law can uphold a verdict against them. Yes their views are outrageous. Yes they are vile. How did they violate the the law?

I guess they should have the RIGHT to say whatever they want, but they ought to know better. I think most people would see them for what they are. Ultimately, people like that hurt their cause way more than theyhelp it.

I agree but the courts are not there to teach people to know better, it's there to 'uphold the law'.

A law professor told me once that the constitution is there to protect the right of the minority from the majority. It is there to protect the voices you hate the most. That stuck with me.

I believe it was filed as a civil suit. Thus the claim of invasion of privacy & emotional distress.
They intruded on a family at a private moment.

Not sure if that was a shot but even though I am not religious, I do respect others rights to lead their life as they so choose.

The poetic justice part of me would like nothing better than for these self righteous SOB to go bankrupt and fall off the face of the earth. To take this out on the survivors of a loved one who dies at a presumably young age and in combat is vile and disgusting.

Having said that, we do not base our laws and things 'we just don't like'. If that were the case, we would all be in big trouble. I do not exactly see how invasion of privacy works exactly (maybe one of the pros will chime in) but if the cometary is a public place then they should be in the clear. If the cemetery is a private place, then the cemetery should forbid anyone to come there who is not visiting a site and have a code of conduct. If someone violates the rules, kick them out or arrest them.

Ten million dollars seems like someone was just pissed off and took it out on them. Do they deserve it? Hell yes. Is it right? In my opinion no it is not.

No way that will stand--suprised it didn't get tossed on a JNOV, remittitur or other post trial motion (speaking of which I won't elaborate since I should be getting ready for trial tomorrow). And it should. Plaintiffs will have to pony up some $ for defending it on appeal

On the Dees thing, I want to say that woman ended up actually collecting $3+/-M. Dees is a condescending, dismissive prick in person, but you are right, that was a sweet victory. Not an original idea though(as he claims)--I guess the movement started with Capones conviction for tax evasion instead of murder they couldn't get him for and then the then evolving wrongful death statutes ala OJ for the non lawyers.

Well, defense lawyer wife says the invasion of privacy thing may have merit in light of the expectation of privacy of a funeral.....Think I will get on Pacer next week and order the complaint and maybe a trial brief if one was filed
