What can I do with my brick-shoed neighbors?

Please give me some input. I live in an apartment building, below obese, brick footed people. The walk like they have bricks in their shoes. I've tried everything from pounding on the walls (I've already had to patch a wall), to asking them politely. I've complained to my landlord, and after the third complaint, she mentioned that they stated that my music is on at all times, day and night, and loud. This is not true, but what's pissing me off is now they are lying about my actions. They are ignorant, fat bastards who now will stop at nothing to annoy me, and keep my chick and I up at night. They never sleep. This is no joke. My landlord is saying that basically there is nothing that she can do. Can someone please help me?

Not much, other than move.

And if your music is even remotely loud at any time, well, you aren't all that civil either. Nobody should hear your music but those in the apt.

Buy a small house - you can get one very cheap these days.

In attemp to shut them up, I've totally eliminated my stereo, so no qualm there. Nothing has changed on their end, of course.

Christ, it sucks when apartment neighbors are blatant A-Holes.....especially upstairs a-holes.

Matt, you just have to move units, or buildings. Sorry.......that's all I got for ya.

I've already tried. They won't let me transfer. I'm only 4 months into my lease. I'm devising ways to make it unbearable for them, as they are doing for me.

Making it unbearable for them won't help your situation.

You need to rethink you strategy. You need to break the lease. You won't do it being an ass.

Prove that the neighbors upstairs are making your apt unlivable. Then you may just have a chance.

Buy a house. Where are you located? I can refer you to another Re/Max agent if you would like.

As for breaking the lease you need to read up on your states tenant/landlord laws. The laws favor the tenant.

You need to read the lease carefully. Usually, there is a "warrant of habitability" which requires the Landlord to provide a living space that is "habitable". If the neighbors prevent you from sleeping, the space is not "habitable". You would seek redress in court for a partial rebate on your rent.

First, document the issue in several certified letters to the Landlord, mailed every week and stating the problem each time. This builds your case. If the Landlord refused to do anything about it, you've got some good evidence to bring before a judge.

If you're in a tenant friendly state, it's possible to get 50% of your rent returned to you if you convince the judge of how miserable the accommodations were.

I've had it happen to me........by a very destructive and creative tenant.

If the landlord has a top floor apartment available ask to switch.

PUt ear plugs in at night.

Going to war will just make your life focus on the war. Chances are the folks upstairs are totally unaware of their actions.

Is it a wood floor finish? If so shoes will simply make noise when they walk.

Matt, you remind me of someone else I know. I never realized that particular drawback to living in multistory housing. I've never had anyone living above me.

I know it's irritating. I hoipe you can work out a good solution. There is certainly plenty of ingenuity and brainpower available here.
