Actually, he actually might be. That's the beauty of a free economy. Sellers can list any price they want. Whether they get it or not is a different story.
Think about it. How different is that situation from some home seller who demands an above-market price for his home because he put in all these extras into his home (but did nothing to increase its value). He will continue to want at least a return of his 'investment' regardless what the market will bear. That is, until his liquidity holds out. Then the invisible hand of economics lowers the price for him.
