Hit and Run?

In a case like this where the driver hits and runs but returns a short time later, do you believe the hit and run charge should be dropped or altered?

Nope. Once you do that then you have to start talking about time limit. How much time after the hit is OK. 5 minutes, 20 minutes, an hour, 4 hours? Just leave it nice and clean, you leave or you attempt to leave the scene its a hit & run.

I could drop the charges if it were me under certain circumstances. Now, I understand panic. Been there, done that. You do stupid things. So, if I have to come looking for you and catch you hiding somewhere, not a chance. However, if you panicked and came back, I might consider it ONLY IF the victim didn't die as a result of your fleeing. IOW, if the victim was lying in the ditch and was bleeding to death, no. However, if someone else was there and could render aid, that might be worth considering.

I might consider where he ran to. There are parts of town in which if I hit someone or something, I'll keep going and turn myself in at the first safe opportunity.

I doubt that in a case of death that the charges would ever be dropped. The judge may take it into consideration when sentencing though.

I guess that's why we have judges and juries. If there are extenuating circumstances, they can take those into account. Otherwise we could just have computers spitting out justice . . .

The hit and run is largely irrelevant..............

"An assistant district attorney, Erin LaFarge, told the judge that Mr. Anderson had been driving at 60 miles per hour when he allegedly hit Ms. Cioffi.

“The woman flew into the air and was killed,” Ms. LaFarge said. She said that according to the police officers, Mr. Anderson smelled of alcohol, his speech was slurred, and his eyes were bloodshot."

He's going down for manslaughter............nothing's going to stop that.
