Don't know if the following article was posted previously, but it is a worthy read and illustrates the house of crooked cards that defines the Bush administration is starting to crumble - and a small amount of delight is that the decision is by one of the president's appointees:

President Bush's top advisers are not immune from congressional subpoenas, a federal judge ruled Thursday in an unprecedented dispute between the two political branches.

House Democrats called the ruling a ringing endorsement of the principle that nobody is above the law.

In his ruling, U.S. District Judge John Bates said there's no legal basis for Bush's argument and that his former legal counsel, Harriet Miers, must appear before Congress. If she wants to refuse to testify, he said, she must do so in person. The committee also has sought to force testimony from White House chief of staff Joshua Bolten.

"Harriet Miers is not immune from compelled congressional process; she is legally required to testify pursuant to a duly issued congressional subpoena," Bates wrote. He said that both Bolten and Miers must give Congress all non-privileged documents related to the firings.

The ruling is a blow to the Bush administration's efforts to bolster the power of the executive branch at the expense of the legislative branch. Disputes over congressional subpoenas are normally resolved through political compromise, not through the court system. Had Bush prevailed, it would have dramatically weakened congressional authority in oversight investigations.

The administration can appeal the ruling.

Speaker Nancy Pelosi, D-Calif., called it "very good news for anyone who believes in the Constitution of the United States and the separation of powers, and checks and balances."

Democrats swiftly pledged to call Miers before the Judiciary Committee as soon as September to testify about whether the White House played any role in the firings of nine U.S. attorney's last year.

Judiciary Committee Chairman John Conyers, D-Mich., said he hoped that Miers and Bolten do not appeal the ruling, but that was far from clear.

White House spokesman Tony Fratto and Justice Department spokesman Peter Carr said they were reviewing the opinion and declined immediate comment.

Nonetheless, Conyers signaled election-season hearings will be held on the controversy that scandalized the Justice Department and led to the resignation of a longtime presidential confidant, Attorney General Alberto Gonzales.

"We look forward to the White House complying with this ruling and to scheduling future hearings with Ms. Miers and other witnesses who have relied on such claims," Conyers said in a statement. "We hope that the defendants will accept this decision and expect that we will receive relevant documents and call Ms. Miers to testify in September."

Bates, who was appointed to the bench by Bush, issued a 93-page opinion that strongly rejected the administration's legal arguments. He noted that the executive branch could not point to a single case in which courts held that White House aides were immune from congressional subpoenas.

"That simple yet critical fact bears repeating: the asserted absolute immunity claim here is entirely unsupported by existing case law," Bates wrote.

Nancy Pelosi calling for anything is way out of bounds! Then waving the Constitution like a piece of jewelry when it suits her? Big piece of ***** bit*h that ought to be the first public hanging in a century!

She has blocked every vote except her own on her own little power trip! The House Republicans who purposefully stayed and tried to force a vote for getting access to our own resources were forced out of congress by a marshall after Pelosi denied a vote on anything!

God i cannnot wait until people come to their senses and boot these stupid liberals out of congress! You thought their approval rating was low when it was held by Republicans at 32%? Yeah, now it's down to 9% and slipping!

67% of the people in this country, which is where the power is supposed to be, want to drill for our own resources while exploring every alternative we can use, but no! Congress wants their own liberal Democrats to block any drilling, raise gas taxes and even Barrack Obama has said that he does not approve of new batteries for electric vehicles because as he put it: "We must stop people from driving these vehicles in the first place" What?????

And her partner in crime Harry Reid should be tarred and feathered! Bring back the pitchforks!

As for Karl Rove, he has said over and over that he would testify, but not in a public hearing in front of cameras since we are dealing with National Security issues. MSNBC? Leave it to them to blow this out of proportion! Typical liberals, create a problem and then quickly assign blame to throw the spotlight off of yourselves!

Wow, that's a stretch, even for Karl Rove. He gets subpoenaed to explain his role in the allegedly improper dismissal of US Attorneys and in the use of criminal investigations for partisan political purposes, and that's "National Security"? If people want to support Karl Rove, that's there prerogative, but please quit spreading this sort of disinformation.

Undoubtedly.

That's why everybody hates being deposed or put on the witness stand in a courtroom. I doubt that there are many lawyers that like the idea of their clients being put in that position before a hostile interrogation.

Remember, Congress is not the judicial arm. It is one of 2 political arms. By definition, their purpose is always and every time, political. It cannot be otherwise. I have no doubt that Rove would prefer to take his chances in the judicial system.

He'll run out the clock, anyway. After Jan 20, 2009 nobody will give a chit about Rove anymore than anybody gives a chit about George Stephopolous,

You know who that is, right? He miraculously morphed from being a highly partisan democrat political advisor to President Clinton into being an objective news man on main stream TV. Unlike those hacks on Fox News who are all political and everything.
