Got rearended today

I had to make a sudden stop not going very fast, and the guy behind me said I stopped too soon. He told me not to call his insurance, I did anyway. Uhh I would I know that he does not have insurance etc etc. He could have just made a fake card. I called and they varified that he did have insurance. He thinks that he is going to pay for it out of pocket. But he does not realize that it is going to be more then $100. He hit my 1992 Volvo 745 turbo wagon. It looks like it is going to need a new bumper over and a new tailight. I'm worried about the bumper shocks, and what ever is behind the bumper. I'm going to have a body shop guy who specializes in Volvos look at it tomorrow. It does n ot appear as if any of the sheet metal is acutally damaged, so hopefully, the extent of the damage is just this bolt on stuff.

Now here is my rant...why in the h### can't people pay attention when they drive. This guy has apparently had several accidents, as he said he had to call his mom to see what he was supposed to do next time he had an accident. So, this was not his first. Also, his car was smashed on all four corners. My 85 year old gradmother realized that she should not drive any more, so what did she do you might ask????? She STOPPED DRIVING! This seemed like an obvious choice, but this guy can't figure it out.

Anyway, I'm sure my car will be fine, I will drink some nice wine tomorrow night, and maybe I will feel better, but I'm even more outragged by the fact that the cops would not show up.

Any advice. I really love this car, and I don't want it to suffer from this day. I'm going to insist on oem parts, the light and bumper cover, hopefully that is all it will need. Are the bumper shocks a one time only deal...maybe they should be repalced too? Thanks for any infomation...Nick.

Do you have anti-lock brakes on your car? I read once that cars with anti-lock rear-end less and get rear-ended more. Maybe that's why they don't give an insurance discount anymore for them. Anyway, I will tell you what I believe to be true based on my experience. First of all make sure you are not injured. If you are sore then be careful what you sign or say to his insurance company. You do not want to take advantage but you also do not want to give up you right for compensation. Hopefully you are not hurt as it is very hard to prove soft tissue injury. Anyway, in this state you have the right to have your car fixed where you want. I would strongly recommend against using the shop his insurance company recommends. They will offer a lifetime warranty which is as good as a lifetime warranty on a 10.00 car battery. Find a good shop and have them do the work. And as far as him saying that you stopped too fast, that is the biggest crock I have heard. He stopped too slow. His liability: 100%. Your liability: 0%.

Hey, thanks for the good advice. I'm going to have a shop that my mechainc, and the Volvo dealor recomend. Mine does have anti-lock brakes. Hopefully their is no paint work that needs to be done, however if their is, my particualr Volvo came from the factory with a red single state finish. If, their is finishing work that needs to be done, I would not want clear coat added to my none clear coat car, so hopefully single stage could be re-applied if needed. So, I'm going to have one new tailight, and another one that is as old as the car. They won't repalce both as that other one was not broken, so it looks like I will be buying a new tailight for the other side so they both match. I guess this is my choice, but I don't want miss matched taillights.

I'm always leery of the "don't call the insurance company I'll pay myself" angle. Not having much accident experience, is there any recourse with his insurance company if he balks at the price of OEM parts and dealer repair? Especially if the cops didn't show up to file a report? Sorry to throw the pessimist angle in there, just make sure you cover yourself. I'm all for helping a guy out as long as it's not at my expense.

Having teenage drivers at home might change your opinion about this, if your kids are the offenders.
I worked out a couple of "cash deals" to pay for other car damages to avoid having to go to MY insurance company with claims. Minor things, but all rear-enders.
I was glad to be dealing with understanding adults, because here in Jersey, car insurance is hugely expensive, about the highest in the country, and claims will kill your point score.

You're much more understanding than my father! But I'm sure my opinion will be tested.

Last fall, the X-wife got rear-ended at a controlled-right-turn intersection that is infamously known as a "beater" - as in "beat the red-light" - even though she had the "green" - she slowed down just enough to look left to see if there were any "beaters" bearing down on her driver's door...instead, she gets "popped" by a "beater" Cavaliar, from the rear...

The lady jumps out of the car, runs up to the X's and starts screaming about "...Why did you slow down?" and related discoursing....

X gets rattled, but dials 9-1-1 to get someone out there...then the Creepy Lady gets all pissed and starts screaming at the X some more...she didn't want cops involved, but now they're coming...

Well, Creep Lady gets on her cellphone, and before the cops show up, two of her kids are on the scene...X is still in the car and won't come out 'cause it's 3-on-1 and the odds suck...then the cop shows up...

Creep Lady gets in the cop's ear about how X "stopped" at the green light and tries to make it look like she's in the clear...then the cop asks for her license...now we find out why she didn't want the cops called...the tears start flowing and she's going on and on about needing to pick up some cough medicine at the Wal-greens...blah, blah, blah...

Cop finally gets X to roll down the window and she starts to talk to him...she's having a "panic-attack" due to Creep Lady and the kids...I arrive just as the cop is talking to X and I notice Creepy Lady's kid is trying to wipe paint flecks and chips off the 123...I yell at the kid to get away from the car...the cop wants to know where I'm coming from and relay the fact that I own the car, the kid is mucking around the impact point and I have no intention of getting any more involved...I'm there after the fact...

The kids are told by the cop to hit the curb w/their mother, who is still trying to get the point across that she's was only trying to be a "good mother" by getting the medicine the family needed...

The X ends up getting stuck in an ambulance because of the "PA" and the previous heart-attack she had...Creepy Lady gets a few tickets for DAR and DWAL (Driving After Revocation/Driving Without A License) and is told that the car isn't going anywhere for the rest of the evening due to the fact that no one in the family is legit enough to drive...the kids ended up "hooving" it back to whereever they came from 'cause the cop sat at the site for a while doing the paperwork and made sure that nobody was leaving behind a wheel that wasn't able to...I was able to get the 123 out of there and came back for the truck a little later.

Interesting point though...Creepy Lady STILL HAD INSURANCE...and it took care of everything 100%...there wasn't any damage to the 123, just her car and nobody gave a rat's butt about that thing. I had my camera with me and I took LOTS OF PICTURES, of both the 123 and her POS...the cop thought that was cool...it pissed off the Creepy Lady and her brood, but the cop told them that what I was doing was perfectly legal and he even pointed out that I might be saving him some time and hassle. They just stewed...

Point here...have a camera in your car...even it it's one of those "disposable" one-time-use types...stay in your car and don't roll down your window or talk to the other person until some person of authority is on the scene...and even then, tensions may still be at a fever pitch...so laying low and quietly might still be the better part of the situation...you never know what the other person may have or be "packing" on their person...and most importantly, don't do anything to make the scene even more intense...let the cops handle it...if you call and they won't send cops, write down the time of the call and whether it was a male/female dispatcher you were talking to. Then, get as many photos you can and if you are talking with the other person, just get the license and insurance information...don't get friendly or chummy with them...don't even apologize for anything...that will come back and bite you in the butt...

BTW, Creepy Lady ended up losing her car to a towing company...she wasn't able to get it out of the lot fast enough...the owners' of the lot needed the space she was "hogging" - and the best part? It was Wal-greens...yep, the very place she "claimed" to be heading to for "...her family's sake..." The cop was laughing about her story, to me, when he pointed out that if she had turned into the lot, she wouldn't have hit the 123...

Sometimes, you can't even make up a story fast enough to fit the facts...

Tailgating has become annoyingly common. Combine that with cell phone usage and some SUV driver's entitled attitudes about having to get there first, its no wonder we keep hearing such stories.

Just last night some clown was on my tail, HID lights burning on my bald spot. I just kept going right at the speed limit and made it impossible for him to pass - he was trying to race through MY neighborhood, dammit!

Yep the morons not paying attention gets to me.

I leave a lot of room on the highway, because you never now, and I have had to stop very quick sometimes. For accidents, or DOT trucks, morons. Anyway I have had cars that were ridding me end up in front of me on the grass, because they left no room and their brakes suck.
