I believe you mean corporal punishment. Capital might be just a bit harsh for stealing. But I agree, quit putting petty thieves in jail for a week, until overcrowding gets them spit out again, and just start the caning or whipping. I am also a fan of the work camp and chain gang. Crime would drop if there was an ACTUAL deterrent.
As for the lawyers, it should be more difficult to become one, and easier to lose the privilege. Set the bar higher.

I like what Letterman's been saying in his monologues...bring Bernie to an NFL game, but instead of putting him in some dunk-tank, just lay out a drop-sheet and let everyone lob-a-loogie (or toss some form of a body-fluid) at him...'til the day he dies...

I've seen plenty that can't argue their way out of a wet paper bag.
The outstanding few are a pleasure to watch and work with.

But I guess all the mediocre people need mediocre lawyers.
