Shop dropped/disassembled my transmission without authorization.
Bought a 2002 Isuzu Trooper in June. The PO had the tranny rebuilt in March with a 12 mo warranty.
It started shifting roughly into first. Looking underneath, I see fluid dripping from the drain plug. This model has no dipstick and I didn't feel like a face full of ATF in a 95F driveway. The rebuilder is in the next county so I take it to the local shop, leave the key in the night box and instructions to check the codes and the fluid level. Didn't sign anything. After lunch I called. They said the fluid was low but it still had the problem after refilling and they wanted to drop the pan. I explain the warranty situation, tell then not to open the transmission and let them know I will contact the original rebuilder. When I come in to pickup the truck I find out the transmission is out and torn down. :furious3: Told me they thought I approved it over the phone. But they did remember me talking about the warranty. Just defies all logic that I would have them drop the transmission when it was warrantied elsewhere. I don't want to guess the odds that the other shop will void the warranty because someone else opened the unit. |
I don't know about your state but in Michigan they are screwed.

Is that the sound of an-'nother fresh new reman being jacked up into your chassis?
They are so,so ,so "Arointed".
'Might take you a trip to "Small Claims " court, but they "Bought the Farm" ! 'Worth the time off to hear them try to explain it to a Judge. |

Either the new shop makes it right, or you're visiting small claims..........with a virtual certainty of a win. |
No written authorization to perform work, no chance for them to win. Just hope they don't just slap it back together and put it back in.
