Um, no. The mercedes did not rear end the hyundai. Cars are not autonomous. A drunk idiot rear ended the hyundai, with his mercedes.

By saying "MB rear ends Hyundai" you are taking the drunk idiot out of the equasion, and implying that the machines caused this.

Keep the blame on the drunk idiot because really, does it matter what kind of car he was driving? The outcome would have been the same whether he was driving a mercedes, a ford, or a peugeot.

It's a shame... Just saw this on the news the other night. Buyers beware: Your new Mercedes will tattle on you.

Sequence of events showing this Doctor playing golf with his buddies at the Raleigh Country Club on Saturday before spending time at the country club bar. Later he showed up at Piper's, who served him one drink and then refused to serve him anymore. Piper's was concerned about his driving and did not want to let him leave, only letting him leave since they thought he had a lady friend who was going to drive. Cell phone records show that at the time of the collision he was also talking on his cell phone. Let's see, driving drunk, talking on a cell-phone and other data (I assume "black-box" data from the Mercedes) that now shows he may have actually been doing 90 mph! A recipe for disaster that has destroyed his life, the life of the ballerina and both families lives.

He has turned in his license as a Doctor and will never get that back again. He was on the staff of UNC hospital making $297K/year which is now history and has been forced to give up his other job working as a plastic surgeon. Civil suits will probably take everything he owns.

Hope you think about this the next time you are out having a few drinks or talking on your cell-phone while driving. You could end up throwing your whole life away and the lives of others and your families. Just not worth it!

Wow do you really want this car?

Investigators requested the records, as well as GPS data, to help them determine Cook's whereabouts leading up to the accident. That information was needed to help determine where and how much alcohol he had consumed, and also identify the woman Cook was seen with at The Piper's Tavern, Raleigh officer C.A. Bradford said in the court order.

Police also seized the electronic data recorderfrom Cook's car, according to separate search warrant application filed in court Tuesday. The device will reveal other evidence such as seat-belt and headlight use.

Sorry, but I blame the AMG Mercedes. If he was driving a smaller, lighter and much less powerful car, this accident would have been much less severe, or possibly would not have occurred at all. The state of the AMG Mercedes driver's sobriety had little to do with the death of the poor girl who was sitting in that flimsy $hitbox.

This part is sort of a shame, yes he should loose his job, and most of what he owns.
But why not let him keep his license, and do charity work from now on.
Either as a plastic surgeon, or even a regular doctor, he should have those skills as well.

Just a waste to see his years of education etc go to waste.

He's a murderer. He should fry like any other.

Agree with the idea of putting his talents to good use.
He should do pro-bono work for underprivileged families and children that would otherwise never be able to get treatment.

Please tell me you're kidding.

If not:
This is without a doubt, the most ridiculous (I could sub in a list of other adjectives here.) statement I’ve seen on the board in some time.

Just curious:
What type of automobile can a person be driving while intoxicated, that when they hit and kill someone, it’s solely the fault of the intoxicated driver?
Also: If I get drunk and decide to take my loaded to 18.5K Ford F550 out for a drive and accidently run someone over. We can just blame the truck and leave me out of it, right? After all, it's so big when compared to a "$hitbox" E55 AMG Benz, right?

I think what burns me the most is the continual efforts by the media to portray doctors as benevolent, caring, sensitive citizens who experience deep emotions for their clientele.

Not to say they are all the antithesis of that, but the term "God Complex" comes to mind. And once they're rolling high status, what is there to mitigate any manifestation of superiority complexes?

As a practical matter he is a murderer, but the defense will (correctly) attempt to point out that a necessary element in murder, is INTENT to kill.

Probably here, there was no such intent.

Unbelievable negligence, totally drunk, on the phone, blew a red light in an '05 E55 AMG (which at 90 mph feels like going 40) and crested a hill then immediately blasted into the tuna can and killed the girl.

Don't know the law, but sounds like some form of manslaughter; NOT premeditated murder though...

Only difference is the degree and AMOUNT of TIME of his punishment, in years in jail, --- the girl is just as dead either way and it's his fault alone.

NO WAY will he fry under the NC laws though, imo.

But his days of living "La Vida Loca" are done -- for sure.

Yes. Evey car should have, and will eventually have this. Perhaps if his car didn't have some sort of black box functionality, the prosecution would have a weaker defense. Is that what you would want in this case?
