The First Amendment & The Modern World
First, A Student's Rant Page on Facebook Is Protected Speech
The U.S. Supreme Court has never squarely addressed the parameters of off-campus, online student speech. The courts appear to be guided by the high court’s 1969 Tinker decision saying student expression may not be suppressed unless school officials reasonably conclude that it will “materially and substantially disrupt the work and discipline of the school.”
Heckling a Public Speech With Your Free Speech, Isn't a Free Speech Right
The speaker —Michael Oren, Israel's ambassador to the United States— was repeatedly forced to stop his talk. He pleaded for the right to continue, and continued. University administrators lectured the students and asked them to let Oren speak. In the end, 11 students were arrested and they may also face charges of violating university rules.
Finally, Getting Your Fans To Flood Judge With E-Mails is Contempt, Not Free Speech
Best-selling author and infomercial pitchman Kevin Trudeau, 47, is shown here leaving a Chicago court yesterday after Judge Robert Gettleman, who was barraged by e-mails from Trudeau supporters, sentenced him to 30 days in jail and fined him $50,000 for contempt of court.
