I'm just pointing out that what is being called a "background check" for a gun purchase is a joke. When folks complain that someone isn't caught during these checks, they need to understand the difference between glancing at a database and doing a "real" background check.

No, I'm not suggesting that gun owners be subject to a Q-Clearance/Secret type investigation, but it might make sense to subject them to a $500/2-week investigation that involves a little legwork and a couple of phone calls. At least they might weed out the real whack-jobs.

Unfortunately, it is very easy for anyone over the age of 10 to buy a gun on the street if they have a few $100, so the other half of the equation would have to involve very significant penalties for anyone possessing (or selling) an unregistered gun.

Guns don't have to be registered, there is nothing illegal about buying a firearm from a private party with a handshake in most states.

Hopefully not, I have no problem with it.

Back in the old days you used to be able to order them out of the Sears catalog. Now the CMP is the only program left that ships right to your front door, thanks Uncle Sam!

There isn't much point of imposing rules on gun shops when someone can avoid them by just buying a gun privately. All that does is impose a burden on those businesses and creates an opportunity for an underground market. It's a silly loophole; if it is constitutional to regulate licensed dealers, it is also constitutional to regulate private transactions.

It's legal for a private sale of a legal item. Free commerce.

When I sell a gun to someone in state, privately, I get their drivers license and social security numbers. I also have a written and signed document stating my former gun has a new owner.

This need some serious work. In 2003 when I moved over to the US I got my first BDA380 from a dealer. Thinking in a different way as European I went to my local Police station wanting to register the gun with them. What happen afterward was funny. The cop on the front desk told me just to go home and enjoy my new gun. He never asked me who I am, who sold me the gun, he never even asked me if I was legally in the country for that matter. I put a gun on his desk and he didn't even look me in the eyes, just told me that there is not such a requirement. I asked him what if I bought the gun from a private party and the only comment he made was: I hope that the gun is in good working order????

So following your suggestion I need to be penalized because the system sucks. I own 2 H&K Compact's now and I never registered them with anyone. No one asking for such a thing. I am more than happy to oblige but as the officer told me, no one is asking...

Not having them registered makes it harder for the feds to confiscate them later if they decide too. That's what they did in disaster areas like Katrina!
