An Unspeakably Bad Legal Situation in New York

A New York court has ruled that a tax must be charged on admission to a strip club and the lap dances from the dancers within.
This ruling came after Nite Moves lost a case they had been fighting since 2005, Reuters reports. According to the Reuters article, in a 2005 audit, the New York Division of Taxation found the club owed around $125,000 for admission and private dances. The owners of the club argue that the dances are dramatic or musical art performance, which is not taxable. On Thursday, jury ruled that the owners could give enough evidence that proved that the lap dances fell under the tax exempt performance category The jury panel ruled "In short, petitioner was denied the requested relief due not to the nature of its business but, rather, because of the inadequacy of its proof." A NY Daily News article the judge was quoted saying, ""The record reflects that the clubs' dancers are not required to have any formal dance training and ... often rely upon videos or suggestions from other dancers to learn their craft," the judge wrote. Reuters wrote that this was the decision despite an expert the defense brought in that said, "the presentations at Nite Moves are unequivocally live dramatic choreographic performances." The court said that the expert had not seen the dances at the club in question but based her opinion on dances seen at other clubs. The court also said that the DVD submitted by the defense did not have any examples of private dances on it. Metro News New York did the math stating that An 8.875 percent tax would cost clubs about $2 on a $20 dance. Nite Move's lawyer says the company plans to appeal the decision.

Sounds like another cause for the ACLU. They have, in the past, represented advocates of "pole fitness" organizations . . . and we're not talking triathalons for polka bands.

As of last night, I am sure my pole is fit, any way you want to take that phrase. I think they even have classes where they teach a person to strip. Miss Pole, IIRC

This puts a crimper on the poor college students trying to make a buck so they can better themselves.

I don't believe in giving them money since it sets a bad presidence. I prefer to teach them to work for their money. I have supported many a poor college student trying to go thru school and making a few bucks to improve themselves. I like to think of it as doing my bit to promote higher education in the country and I put my money where my mouth is in this case.

Well, with some you can put your money where their lips are. Generally, I put my money where my mouth is and they take it from my lips but NOT with their hands. For those reasons, I only go up to the stage area after the 2nd or 3rd song when they have gotten most of the pesky clothing off. After all, I don't want to be sold a bill of goods and I want value for my money. As such, I have to see the merchandise before sale.

Yes. We should have information before coming to a conclusion. I volunteer myself to research the issue at the strip clubs. I understand it is a bad job but before I advocate for them, I really should commission a research project

Strip club? That's prejudicial language. How do you know it's not just really bad ballet? Music, dancing? "On stage 2, Tiffani, performing a modern interpretation of Swan Lake to modern soundtrack..."

Bet if ya tried hard enough, you could get a federal grant for the research. Worst that could happen, they say "NO"!

If I even thought that would be possible for the taxpayer to pay for my research, I'd be all over it like a cheap suit.
