"Pass This Bill" and create a new Protected Class of American

The Dear Leaders American Jobs Act:

"We are adding in this bill a new protected class called 'unemployed.' Titled on page 129 prohibition of discrimination in employment on the basis of an individual's status as unemployed and it says right here in the findings, '...that we find the denial of unemployment opportunities to individuals because of their status as unemployed is discriminatory and burdens commerce,'" Congressman Gohmert said.
"So the good news is if you're unemployed and you go and apply for a job and you're not hired for that job, see a lawyer. You may be able, to file a claim, because you got discriminated against, because you were unemployed."

A friend was once considering running for office. I asked what his platform would be, and he said he wasn't sure about his actual platform, but his slogan would be, "Every citizen: a victim!"

How could he not win with a catchy slogan like that?

Not long ago I would have heard this idea and said wtf Now with experience I see where they are going with it, when I was hired for my current job they asked for my last 5 years employment with no gaps I had a paper work gap of 3 months that I had to jump through a lot of hoops to fill and I asked the hiring manager about the people who were simply without a job for 3 months, she said that they would be disqualified.

I didn't go any further into the discussion but the current labor market is so saturated that employers can cherry pick employees from other employers and don't need to tap the unemployment market to fill positions.

With that said, if you are fired or quit a job and you want to get a job with a major corporation, go to school or find some kind of interim job to fill the gap.

What would they think if you didn't collect UI and just wanted some time off? I plan on retiring in three years, but might return to the job market if I get bored.

It's at times like this that Rep. Gohmert wishes he hadn't squandered all of his credibility. It sounds like he might be on the verge of actually making a valid point. I wonder what remedy the bill proposes in cases where employers engage in that type of discrimination.

I just got off the phone, talked to Nancy P and she told me we'll have to pass the bill to find out what is in it with regard to specific remedies!

I haven't read the entire proposal but it very well may be that the Dear "Harvard Law Review Editor/Constitutional Law Adjunct Professor" Leader doesn't include that in his proposal and possibly expects that the Congressional Super Committee will fill in the details after they get the funding part straightened out.
