Was the victim shot as a consequence of his military service or as a consequence of his actions as a private citizen?

You posed your question as a consequence of action, not a legality of action.
You are wrong, again. and doubly so, because the marine was not dressed in uniform.

Lets see, you are in a riot, facing a guy with a tear gas gun, be told what to do by police with bullhorns. What DO YOU THINK is going to happen? Those guys disgraced their uniforms (not talking about the cops)

Who was in uniform, besides the cops?
It's the right and duty of citizens to disobey unreasonable orders from anyone. The same goes for those in uniform, or so was said at the Nuremberg trials.

"Once a Marine, Always a Marine: This truism is now the official motto of the Marine Corps League. The origin of the statement is credited to a gung-ho Marine Corps master sergeant, Paul Woyshner. That is correct, although there are no former Marines.
I have no idea why or how some idiots think he was in uniform.
