Fat woman on stilletos= workman comp claim?

A fat woman wearing shoes with a very pointy heel (the tip of the heel is less than one square centimeter) falls while putting up christmas ornaments in the office.

I guess it is a valid workers comp claim but where do you draw the line between validity and stupidity?

Now she is out for weeks during the busiest time of the business. jeez.

Part of me suspects a malingerer i.e. the fall was staged and intentional.

That line no longer exists. While extremely over-simplistic, if it happens at the workplace (or can be made to look like it was) it's a comp case. It's the reason we got rid of our basketball hoop despite its popularity at lunch break.

Heck, my own kids can do that. Although as the former captain of my varsity H.S. basketball team I can attest that I still haven't lost my touch. It's as bad now as it was then.

I think its her own fault. Wearing those types of shoes in an office environment and trying to do anything other than walk a few steps or sit while wearing them is not going to end well.

Does your work place have guidelines for proper footwear and what is acceptable/not acceptable?

Flats, dress shoes,closed toe anything, and pumps(for women) are all I have ever seen in the guidelines for any office place I have looked at.

Get a modified duty slip from her MD and get here back in the office doing something. Don't let them lay around at home and collect $$ and watch the Plantiff Attny commercials.

Really depends whom you're dealing with. When I was still a full-time employee, I was hurt at work (drill bit slipped while installing some building automation equipment and hit my finger, ripped the side open nicely). Cleaned it up, stuck a bandage on, and kept at it -- I suppose I could have gone to the hospital, got stitches, and filed a comp claim, but I'm not that vicious and didn't have that much time on my hands anyway since I wanted to finish the project and take Friday off to go skiing

I suspect that most people who get hurt at work don't sue or claim at the drop of a pin -- it's a few outliers with frivolous claims that give every employee a bad name.

Outstanding! That's the way minor injuries should be dealt with IMHO. Kudho's! I've had plenty of injuries like you describe and that's the way I've always handled them. The lawyers already have too much to do.

That's why I have a first aid kit on the side of my toolboxes and keep finger splints in my drawer. If I would have gone to the ER for every cut or broken finger I've sustained at work, I'd never be productive. I learned, through experience with the first couple of broken fingers, to tighten it up in a vice and set it myself, and keep going.

A friend of mine is in surgery today on a workers comp claim...he was at work and a martini glass shattered in his hand, nearly sliced his finger clean off. No fuss from the bar (employer), despite footing the bill...he's at front seating people now. My old workplace (a warehouse) was home to a number of injuries, i saw some nasty ones. There are definitely legit wc claims! Fat woman in stilettos should go after mcd's for involuntarily increasing her center of gravity
