U-Ship/credit card dispute issue - PeachParts Mercedes-Benz Forum

Contracted with a hauler 5/20 to pick up and deliver a sailboat by 6/30. Gave 50% deposit.($450) Terms of contract said he needed 5 days cancellation notice to refund deposit. Inquired on 6/9 regarding boat pick up. He said he would get back to me. Nothing on 6/25. Left repeated phone messages and e-mail 6/25-6/28. 6/29 he sends e-mail saying on 7/2 he would contact me. 7/2 no contact. 7/3 I cancel via U-ship. Credit card initially refunded my deposit due to the fact he did not deliver. He's disputing that refund on the basis of his 5 day cancellation requirement. Opinions on who will win the credit card dispute? In my view, the cancellation notice is moot since he failed to provide the service by the agreed date.

In your original U ship ad, what did you show as the latest pick up date?

It said pickup by 6/30.

You will be fine. I have shipped hundreds of vehicles with U ship over the years and only got beat out of $350 one time and that was my stupidity, but the wisdom gained over time is priceless. Keep U ship in the loop and tell them what you are doing with your cc company. Feedback is a powerfull tool on USHIP

Pickup of the boat is different from getting back to you. He could have easily kept in appropriate contact with you and kept you informed, even if his truck was floating in the bottom of a lake right now and the pickup was delayed.

I have never, ever, ever had a car picked up or delivered on time by a shipper. I don't bother waiting on them anymore and just show up when they call at my shop wondering where I'm at.

Absolutely. I knew the guy was unreliable shortly after I contracted with him since he failed to stay in contact or reply when he said he would. I wasn't confident he would show up on time (or at all) to pick up the boat but I waited until the end of our contracted period to cancel the shipment.

I have shipped another boat using UShip and that shipper performed exactly as he promised.

If no services were exchanged I don't see how he can keep your money.

His current argument is that his contract states he is not responsible for delays due to natural disasters and there were tornadoes in Florida where he lives. He lives in Daytona Beach. Tornadoes were in Highlands County in southcentral Florida.
