Let the Appeals Begin!

The scorecard so far:


Jury finds Samsung infringement of Apple utility, design patents for some (though not all) products.
Jury finds willful infringement on 5 of 6 patents.
Jury upholds Apple utility, design patents.
Jury upholds Apple trade dress '983.
Jury finds Samsung "diluted" Apple's registered iPhone, iPhone 3 and "Combination iPhone" trade dress on some products, not on others.
No Apple infringement of Samsung utility patents.
Jury found Samsung violated antitrust law by monopolizing markets related to the UMTS standard.
Damages owed by Samsung: $1.05 billion.

With Samsung being a rather large supplier of processors for the whole line of Apple products, I'm sure we'll see a major price hike in the near future for Apple's devises.

Question. Why do so many companies make the mistake of having something in writing and not put it oral? Don't they realize from past experience that you can subpoena these things be they on paper or electronic format?

I doubt it. Samsung makes the A5 processor under contract for Apple in Austin, Tejas. The processor is Apple's design, not Samsung's. The A5 is used in iPads and iPhones, but not in computers or iPods. There is no reason that Apple couldn't renegotiate production of the A5 with someone else if they thought it necessary. Austin is full of high tech plants that'd jump at the chance to grab that chip contract from Samsung.
Samsung sunk nearly 4 billion into building that plant so they could produce the chips for Apple. A price gouge for payback seems pretty short-sighted. They'll just string it out in court for years and finally settle for a few hundred million in fines.

It is revenue neutral for Apple customers. Apple gets a billion dollar credit. Samsung raises an extra billion to cover the settlement. Of course, the lawyers get a small piece of that too. But, in reality it isn't going to be so simple. This settlement will disrupt all competitors in the area. Apple will get to keep their premium pricing, while reducing competition.

I would be surprised if the legal team wasn't billing hourly, I don't think this was a contingent fee case.

Your questions merely assumes that the truly "bad" stuff is also written down or memorialized.

However, in a split decision on patents, the panel also said Samsung violated Apple technology behind the bounce-back feature when scrolling on touch screens, and ordered both sides to pay limited damages.

The Seoul Central District Court ruling called for a partial ban on sales of products including iPads and smartphones from both companies, though the verdict did not affect the latest-generation phones — Apple's iPhone 4S or Samsung's Galaxy S3.


Secrets Disclosed in Pretrial Discovery

WHERE IPHONES AND IPADS COME FROM When Apple designs new products, about 15 industrial designers typically huddle around a kitchen table inside the locked-down design studio at Apple’s headquarters.

NUDE IPHONES ARE IN THE MINORITY According to an internal consumer survey by Apple presented as evidence during the trial, 78 percent of iPhone users cover their phones with cases.

APPLE MAKES FAR MORE MONEY Both Samsung and Apple revealed more about their device sales than they normally do. Samsung revealed it took in $460 in revenue on each tablet, on average, while Apple said it did better: $558.

SAMSUNG WANTS TO MEASURE UP A 132-page evaluation made by Samsung comparing its Galaxy phone with the iPhone revealed in excruciating detail that Samsung had serious iPhone envy. The lines between the numbers in the Galaxy’s calculator were too thick, for example.
