Avon Gardener: After a woman fell on her walkway during a garden tour, Chrissie D'Esopo of Avon is discontinuing the tours that have raised money for several nonprofits. - Courant.com

I've never met the woman in question but i've driven past this house numerous times and i've always admired all of the work that has gone into the landscaping.


Despite the insurance companies' willingness to cover all the medical expenses for the woman, her husband, who wasn't on the tour, has threatened to sue for his own "pain and suffering" linked to his wife's hurt ankle, D'Esopo said.


"pain and suffering." This POS needs to cry me a river while kissing my a$$ all while I smack him across the face with a shovel....repeatedly.

help us out here - In this article "Avon" is a city in CT, not a brand of perfume - correct ?

(I Only lived in CT for a few years a long time ago)

BUT if you read the last paragraph it says :connecticut has a recreational immunity statute that covers private property owners who open their lands to the public for tours as long as the owners do not profit".

Either a nutjob, or just a greedy a-hole. And there's the possibility that wifey was in on it as well from the get-go.

If the part about the recreational immunity statute is correct, it won't even make it to court - but the owner will most likely still have to hire a lawyer to go thru the motions and provide legal proof that the statute does apply to her.

That said, any lawyer worth his salt wouldn't touch hubby's case with the proverbial ten foot pole - unless he also wanted to become a pariah and bring his practice in that locale to a screeching halt.

One other note - I'll give high marks to the author of the article - seems that some still practice a modicum of journalistic standards - just the basic facts regarding the incident and about wifey and hubby - no opinions, no innuendo, no "trial in the court of public opinion" slant to it - other than what the reader would form on their own after reading it. The infopinion talking heads could take a lesson here.

Frivolous lawsuit -- owner should be able to sue for court costs, and possibly for harassment, no?

If he makes it in the big time, the talking heads will take note of him. Till then, he is merely a nobody that they don't want to be. They are after fame and fortune and not pure journalism.

Anyone can sue for for anything.

Guess you stay home outside of working hours, since you could get into a car accident and be sued for more than your insurance policy amount. Fear isn't the way to live your life.

Being foolhardy certainly can get expensive. i weigh the possibilities and then make sure that I make enough to cover it. I surely wouldn't have given it all to charity. Some maybe but I will keep enough to justify my problems if they come. If not, I win even more,.
