Jury acquits man who killed prostitute because she would not have sex with him

Jury acquits escort shooter - San Antonio Express-News

Quote:
A Bexar County jury on Wednesday acquitted Ezekiel Gilbert of murder in the death of a 23-year-old Craigslist escort.

Gilbert, 30, embraced defense attorneys Bobby Barrera and Roy Barrera Sr. with tears in his eyes after the not guilty verdict was read aloud by state District Judge Mary Román.

Outside the courtroom, Gilbert thanked God, the Barrera family and the jury for being able to “see what wasn't the truth” and for the “second chance.”

Had he been convicted, he could have faced up to life in prison for the slaying of Lenora Ivie Frago who died about seven months after she was shot in the neck and paralyzed on Christmas Eve 2009. Gilbert admitted shooting Frago.

“I sincerely regret the loss of the life of Ms. Frago,” Gilbert said Wednesday. “I've been in a mental prison the past four years of my life. I have nightmares. If I see guns on TV where people are getting killed, I change the channel.”

The verdict came after almost 11 hours of deliberations that stretched over two days. The trial began May 17 but had a long hiatus after a juror unexpectedly had to leave town for a funeral.

During closing arguments Tuesday, Gilbert's defense team conceded the shooting did occur but said the intent wasn't to kill. Gilbert's actions were justified, they argued, because he was trying to retrieve stolen property: the $150 he paid Frago. It became theft when she refused to have sex with him or give the money back, they said.

Gilbert testified earlier Tuesday that he had found Frago's escort ad on Craigslist and believed sex was included in her $150 fee. But instead, Frago walked around his apartment and after about 20 minutes left, saying she had to give the money to her driver, he said.

That driver, the defense contended, was Frago's pimp and her partner in the theft scheme.

The Texas law that allows people to use deadly force to recover property during a nighttime theft was put in place for “law-abiding” citizens, prosecutors Matt Lovell and Jessica Schulze countered. It's not intended for someone trying to force another person into an illegal act such as prostitution, they argued.

Feel free to search further, as I have done. The defense admitted that the gentleperson fired his gun at the car the escort and pimp were fleeing in and that he was trying to retrieve stolen property.

He was engaged in illegal activity that didn't go the way he wanted. So what's next, some guy claims he bought what was supposed to be crack but wasn't so he used his gun to keep the bogus seller from escaping?

The guy here fired an AK47 on a public street because he didn't get the sexual satisfaction he thought he had enter into a contract for. Prostitution is illegal in part because shenanigans/scams like this accompany it.

Here are some stories on it. Better pack a lunch:

No, Texas Law Does Not Say You Can Shoot an Escort Who Refuses to Have Sex

I can agree with this statement, having been a juror on a murder trial that didn't go the way some wished:

"When I see all of that effort boiled down to one ridiculous headline like "It's Legal to Shoot Prostitutes In Texas," I go nuts. I ask people these questions: Were you there every day of the trial? Were you on the jury? Did you deliberate with the other jurors? No? Then SHUT UP. You don't know the first thing about what went on."

Meanwhile, about 10 miles from here the jury for the Trevon Martin/Zimmerman trial is being formed. I need to get out of town....

Texas jury acquit man who shot dead Craigslist escort - Google Search
Well you and rs899 did the searching for me and it appears to me your snippet was a political characterization more than whole picture description of events. Yes the events you posted were accurate- but they were misleading so that the reader would more likely side with the view which the author holds. Reminds me of the common view of FOX news reports.

The best part of all of this is that Conservatives are falling all over themselves defending the guys' right to kill anyone that refuses to go through with a criminal activity the guy admits he was an active part of.

But......

This law was enacted during the 1880's when the only light at night came from the Moon. Crime increased during two parts of the month: During the time the Moon was full since it was easier to see at night and during the time the Moon was dark since it was easier to steal something and not be seen. Sundown is when night starts and sunup is when day starts for the purposes of this law.

The law makes it a criminal offense to use deadly force during the pursuit of a thief in the daytime but legal to do so at night. The best example of this case was in Fort Worth about 35 years ago when a guy shot a thief who was fleeing his shop in downtown at one minute after sundown. The shop owner killed the thief from one block away with a rifle of some type, and the time was noted by several people in the area due to the presence of a large clock outside of another shop.

And that law is what the fellow in this case used as a defense.

The law makes no mention of what duty the wronged party has in protecting the public while they are firing a weapon into the darkness.

Prostitution is legal in Nevada, and I haven't heard of anything like that happening here.
