nothing's ever simple any more
Had a small ranch with a nice house on the market. Rich Eye-talian woman put up 40K earnest $$ with contract to take possession Dec.1
started making demands, wanted this, wanted that, stuff outside the scope of the contract. Realtor now notifies that she's backing out and wants every penny of her $$ back or she'll not sign off and run the contract to it's end date. Feckher. Keeping it. Price was too cheap anyhow.

Been trying to rent the two bedroom house for over two months.
Have had at least 20 people make an appointment to see it. Only five showed. The other 15 didn't show and didn't call. Of the five, two found it to be too small. Three of them definitely wanted to rent it and, for one reason or another, would return the next day, or within two days to place a deposit. Made a confirmed appointment to return and pay the deposit. None of the three showed. Two never even bothered to call. Finally gave it to the real estate folks...........trying to save renters a commission isn't worth the effort. It's NEVER simple. |

No, usually not.
There are many good renters in my experience though. I'd say at least 90% of mine cause no trouble, stay the term of their lease and always pay on time. I have nobody aggrivating me at present. I gave my lady the bill for the HVAC house call ($40). She did not pay it and is no longer asking me for anything. Cool! NO vacancies either.

I don't have to fight. Her buyer's agent is under the mistaken idea that I am in a hurry to sell and will feel pressured to return some or all of the earnest money so she'll release the contract and I can put it back on the market before November. The market here is rebounding nicely. I can wait. Foreign buyer can now tell horror stories about real estate pitfalls in the U.S.
I don't really take vacations. No need to when you live in paradise.

Im looking for a house and honestly I want to inquire about the realtors IQ, till date all the houses Ive looked at were searched out by myself, her and her office never bother to initiate anything.
I really liked a place which we were seeing and asked her to put up an offer, an hour later she calls and tells me it sold 3 days ago, I dont understand how can a house be on the market (door still has the coded lock, yard still has sign) and is SOLD. Its like one of the shady dealerships who advertise a car for cheap and it actually never exists. Never knew it was so stupid to deal with real estate people in USA.

I can answer that.
Most of them are about 85-90. Every so often you get one that cracks 105 and you're positively amazed. |

My question too. The almost-buyer is from Tuscany and clearly has a lot of money. She has a buyer's agent representing her who is from a good brokerage near here, but as near as I can tell she's batshlt crazy.
She agreed to buy at asking price and immediately put the $$ into escrow, the sales contract specified closing no later than Nov.1. Then, the buyer's agent began making demands. She wants the tractor. No, she can have the tractor for 12K but it's not part of the sale. She wants you to open the closed well on the upper portion of the property and get it hooked to grid power and install a pressure tank and verify output. I said no. One day my well guy shows up to take care of it, unbeknownst to me. I told him I wasn't paying him, he said "I threw them a price and they paid it up front, no worries". I'm sure that cost her another 5K at least, turns out it's a great well and I get it for nothing. She wanted the fences in the lower pastures along the creek repaired. I said no, we don't bother with those fences anymore, they blow out about every 5 years during high flows anyhow. Keep your animals in the upper pastures. Now all of a sudden she's decided she doesn't want the place. I don't know if her agent thinks she can bluff me into returning the earnest money or what, but she isn't getting it. The whole thing doesn't make a lot of sense but I suppose there are people for whom 40-50K is pocket change.

Id give her the money back too. You got free improvement to the property out of it already with the well thing, and I wouldn't want to get into a lengthy and stupid lawsuit with this woman. What does your lawyer say about the contract, is there a way to keep the money?
If not, id give it back and call it good to be rid of her. Sell it for more later because of the new well improvement.

My CPA/lawyer cousin tells me she can only cancel the sale for cause and hope to get her $$ back ie; I didn't do something I agreed to in the contract, which is not the case. Her agent has written in emails to my realtor that she has "changed her mind". In other words, she didn't do her homework before making the offer. Oops.
