Landlord question

Hi guys.
I have something developing which I have not had before. I mailed a deposit refund to a former tenant a month or so ago and he says he did not receive it. I tend to believe him but don't want anybody else cashing it either.

If I put a stop payment on his first check is that my cost or his? I suspect it will cost at least $50.

your cost, cost me like 20 something bucks with BOA if I recall.

Pretty easy to do though

I don't see how it could be his cost if he didn't get it. Do you have reason to believe he got it?

If you cannot prove he received it, you must provide him with another check.

If he then cashes the first check, he has committed fraud.

If you stop the first check, the cost is, unfortunately, on you. However, $15.00 is the "typical" cost..........not $50.

What? A landlord actually giving the deposit back? I have yet to experience this.

On topic, send the check certified mail next time. That way USPS will keep track of it 100%

if twalgumuth wants to go full scumbag landlord, he should deduct the cost of cancelling the first check from the security deposit. plus a 30 dollar service fee for having to call the bank. Then he can refuse to mail it and demand the former tenant pick it up instead from the building within an unreasonable time period, like 2 days.

Make sure to look for random bits of the stove clean out drawer that may or may not have been there, and charge him for them missing. Remember, every part of a stove costs minimum 300 dollars, from the drip trays to the burners.

A few months ago we charged a tenant $25 for cleaning a sink, defrosting a freezer and cleaning a filthy stove. She flew into a tantrum, screaming in the apt, running into the yard and doing circles in the street screaming about evil landlords.

I have a list of common cleaning omissions with prices for the task. It is a part of the lease which the tenant has to sign. ...so I rarely get any trouble when charging a fee. My bookkeeper thinks the check is sitting on my desk so perhaps the fee thing will not be an issue.
