Would it make any difference if it was someone driving a Ford Fusion?

Camera bolted to the outside of the car? Looks like he was going for a speed record or Youtube hero status and got burned. Hopefully this will be an expensive lesson not to drive like a douchenozzle on public roads.

He's lucky to be alive, but I hope that his insurance company will not pay one dime to replace his former toy. I ride motorcycles and bicycles quite a bit, and there's nothing that scares me more than wannabe Racer Ricks in sports cars driving 3x the speed limit on the wrong side of the road.

He's also lucky he didn't kill anyone else, or he'd be looking at a few decades wearing pink underwear as a special guest of Uncle Joe Arpaio.

Poor M3 Looks like he went in too hot and the front tires lost grip. I did that one rainy night in Mississippi in my 240D. Luckily all I hit was a lot of grass and was able to continue my trip.

I call B.S. on THIS! The only time I've ever seen the term "too hot" applied to a 240D was in July, in Tucson, and it was referring to the temperature of the car's exterior.

Wait, maybe I misunderstood your use of the phrase, "hit a lot of grass".

It really happened. I was on a road trip to Atlanta in 2010. It was raining wolves and tigers (much worse than cats and dogs); I was somewhere in the vicinity of Tupelo, and was tired, having driven from about the middle of Oklahoma that day and night. It was an unfamiliar and poorly marked road, and I didn't see the turn until it was too late. I ran off in a field, but had an idea where the road was, and managed to maintain momentum across the field and get back on pavement, back to I-20, and found myself a cheap yet still overpriced motel to crash in not too long after. The next day's drive from Tupelo to my dad's house in ATL went quite a bit smoother.

Sadly, it will be you and I who pay for this 22 year old DB to drive a vehicle that is well beyond his capabilities at speeds that are well beyond his capabilities.

I wish the insurance company could decline to pay in such a case. They decline just about everything else for legitimate claims. Be nice to tell the DB to pound sand.

Would attempting to set a YouTube record qualify as a "speed contest or race?" I seem to recall signing a disclaimer that insurance isn't obligated to pay for damages incurred in such events.

They would need to prove that he was in a "speed contest or race". Simply filming a drive probably would not be definitive in that regard.
