Personally, I think that every single person involved in this should be locked up for life or executed (after a fair trial). Deprivation of civil rights under color of law where sexual abuse is involved is a Federal offense carrying a long prison term or the death penalty.

Didn't Hitler's Gestapo force people to submit to medical "examinations" by Nazi doctors?? Do these actions represent the future direction for Obamacare?

Dude, take your Obamacare rants elsewhere. This wasn't an example of medicine or insurance, this was an example of forcible rape by psychopathic cops and their accomplices. Plain and simple, and if the facts are proven in court, the cops involved in this deserve the maximum sentence that the law provides, which appears to be capital punishment. I'm normally opposed, but I make an exception for rape or murder by public officials sworn to uphold the law.

He's suing the police in the same courts run by the same judges who signed the search warrant to force him to submit to medical examination. Obtaining "justice" is becoming more difficult by the day.........

All the more reason why there should be a Federal case pressed against the cops -- different set of courts, plus NM abolished capital punishment while it's still a possibility under Federal law.

There was a case like this in Milwaukee. The primary cop involved went to prison. Ex-Milwaukee officer gets 26 months in prison for strip, cavity searches

They won't receive any capital punishment, at worst they might receive a slap on the wrist. In two weeks everyone will forget about it because the next big news event will be the topic of conversation. This will be "yesterday's news".........

26 months for multiple instances? How about 26 years? Disgraceful.

Then again, if he rooms with the "right" cellmate, he may get what he gave every day, and hopefully contract drug-resistant VD as well.

"State law and police procedures prohibit officers from conducting body cavity searches. Only medical personnel are allowed to perform them, and police must first obtain a search warrant."

This explains why in the OP, they obtained a search warrant which allowed the doctors at the hospital to proceed. All they needed was a Judge's signature on a search warrant and VOILA!, it all became "legal".

Legality is unknown. One case was under Wisconsin law, the other was under New Mexican law. In any case, Federal law trumps both, and I doubt a Federal judge will look favorably upon a search that degenerated into harassment at best and rape at worst.

If they really needed to search anything (which I doubt), an X-ray and the enema should have given them the info they needed without resorting to multiple procedures.

I can assure you that the hospital has more than enough imaging modalities to find ANYTHING he might have hidden within his body. MRI, CAT Scan, Xray, they didn't have to lay a finger on him. Between MRI and CT, they could have easily acquired more intel than any physical body probe or enema would provide. The issue is how far are they allowed to go based on a "search warrant"???

It seems the message here is if stopped by the po po, don't hold onto your ass even if it itches. Keep your hands at your sides at all times.

No, you don't follow the law in every aspect, Chief.
And if this incident followed the "policies and protocols" you have in place, then your entire department needs to be revamped.

I'd have more respect for him if he admitted that the entire thing was a travesty and that they were having the state's attorneys go through their policies and protocols to ensure that such abuse of authority would not happen ever again.

There are reasons that some refer to police as "pigs." These guys exemplify that to a "T."

Of course the medical folks will plead the Hitler defense, "they told us to."

The only shining star in all of this is the emergency room in Deming, which refused to follow the officer's directives (according to the lawsuit).

I hope this guy wins big, and I hope the officers in question go to prison...where they will hopefully have their anal cavities probed regularly by "Bubba."
