Non-disparagement clause

Never eve heard about a clause like this but it's not surprising. I would think that since the clause was added after the purchase the case should be a slam dunk. I love the blow back that is happening against Kleargear.com. |

If the items were never delivered as required by the contract, wouldn't Kleargear be in breach, voiding the rest of the contract?

It is not disparaging if they are generally regarded as scum. They can pretend but you are not obligated to share their delusions.
