Led Zeppelin's 'Stairway to Heaven' Targeted for Plagiarism | Music News | Rolling Stone

Led Zeppelin and Spirit, who had a hit with "I Got a Line on You," played four gigs together in 1968 and 1969 (shows at which Businessweek claims Spirit played "Taurus"). Led Zeppelin also reportedly played a medley of songs that included Spirit's "Fresh-Garbage" – a song that appeared on the same LP side as "Taurus" – on their first U.S. tour.

It's nothing new, it's just that they usually wait a lot longer before plagiarizing.

In college I took music appreciation for one of my humanities credits. I had to find and listen to a number of classic works and write various things about them. I had found and was listening to an obscure piece by Wagner. As I was listening I heard as plain as day, "Love Me Tender." I played it several times and compared it to Elvis' version. It was even in the same key and the chorus was note for note.

Your example seems like maybe independent invention....
Given that mainstream music for the last number of generations has been essentially played on the same instruments, and following the same musical theory, one must come to the conclusion that everything has been played before.
Suggesting that someone plagiarized another's music without being able to show that they were exposed to the previous authors material is dicey business.

More likely is that both Elvis and Wagner caught that riff from someone else and incorporated it into their own pieces.

Musicians have been stealing farom each other for CENTURIES. John Williams would have never had a career if not for "thus spoke Zarathustra". Really classy musicians call it a "quototation" when they "borrow" a passage.

I've been discussing this with some friends on FB. While there are similarities, I don't see it as plagiarism...strong influence, perhaps, but not plagiarism. Led Zep's version goes deeper with added notes, going further on the scale than California's version did.

One of my friends, who is a guitarist, said that many guitarists will play a melody they heard somewhere over and over again, changing it often enough that it becomes theirs. Is that plagiarism or artistic influence?

Led Zeppelin sees 'Stairway to Heaven' lawsuit move forward - UPI.com

Basically, they asked the case to be dismissed from the PA courts since none of Led Zep has any residency or property in PA, so it's a jurisdiction of the court issue.
