Any Social Securtiy lawyers?

How do I find one in my area?

I just got a letter from SS stating that they erred in calculating my monthly benefit and it I deserve $244 less than they originally told me. And I owe them for the extra they erroneously paid me.
That is outrageous. No explanation....just we made an error.
No wrong-doing on my part---its jest an error.

I need to fight this. How do I do that? Do I write my Senator and have her staff

Try running a search for SS lawyers with your area listed in the search....and the Yellow pages has all kinds SS atty's listed.

Do you need an attorney to determine if you received excess benefits?

Or do you need one to save you from having to return the money you've already spent?

Or both?

Have You Checked SSA's Website?

If you believe that you may have been overpaid, but feel that it was not your fault:

ask for a waiver of the overpayment; and
ask for and complete form SSA-632 (request for waiver).

If necessary, we will help you.

You can ask for a waiver at any time.

If we grant you a waiver, you will not have to repay all or part of the overpayment. Generally, for us to grant you a waiver, you must show that:

It was not your fault that you were overpaid; and

You cannot pay back the overpayment because you need the money to meet your ordinary living expenses. You may have to submit bills to show that your monthly expenses use up all of your income and that it would be a hardship for you to repay.

Turns out it was a very poorly worded letter.
I underestimated my earnings last year, and they paid me more than they should have ( the $1 for every $2 earned over what they consider "enough".)
The letter said they were reducing my benefits by $248 a month. What they meant was for that last payment, ( Jan of this year) they reduced my benefit for that month only.
You'd think they could properly word a letter--its actually worse than OD!!

I'm still waiting on my case to be heard. The Docs say I can't drive, I can't operate machinery I fall asleep about 5 times during the day, I'm totally useless, Although a "Substantial" argument can be put forth that I was useless before this OSA (Obstructive Sleep Apnea). Praise the Lord we have been getting by.

You might try to use the services of an outfit called Allsup. A lot of large companies use them when an employee is disabled and I have heard several people say good things about them.

Do you have a financial advisor, or a CPA that you work with?

I am thinking you might benefit from having the CPA on-retainer at the very least. On issues like this, (and many more......) they're worth their weight in gold keeping me out of trouble with the Gov't.

CPA's are also good at referring you to someone who can really work your case. They have far more experience in these areas and know who to call for different types of problems if they think your's is too weird for them.
