Another guy improperly imprisoned in a jail

https://gma.yahoo.com/illinois-man-trapped-jail-31-hours-sues-trauma-163136560--abc-news-topstories.html

Quote:
An Illinois man who was accidentally imprisoned behind a jail's steel door for 31 hours is suing for negligence and trauma.

Farad Polk visited Cook County Jail, where his son is an inmate, on July 5. The guards told Polk to have a seat in a waiting area down the hall, Polk says.

When he entered the room – an area of the jail that was under renovation – the heavy, steel doors slammed behind him, turning the visitor into a prisoner.

For nearly a day and a half he says he tried anything to get someone’s attention. He screamed and pounded on the room’s 2-foot-thick walls, but nobody heard him.
Would be a tad surreal.

The point is that he could have died or suffered severe organ damage (due to thirst) after a few more days had he not been found. This kind of negligence is inexcusable and should be punished.

I don't normally go for suing the state on such things but this kind of stuff is weird. Guy could have died in there. Not sure how he broke the sprinkler off but absent that move, they might have found him from the stink about 8 days later.

That would be way weird to be entombed in a sound proof concrete chamber for 31 hours. Long enough to wonder if you're going to die in there.

I never practiced criminal law, but had to visit a client to get some papers signed. Due to miscommunication, I was (accidentally) trapped on an elevator for about five minutes, and that was more than enough for me.

I'm not sure what the damages should be, but I'm not about to argue with the reality of a claim. After all, part of the point of a legal judgment is also to teach the defendant not to do it again.

Yeah, I am not big on such lawsuits either but this one should go ahead.

I once visited a neighbor who had been jailed for something he should not have IMHO. It was pretty uncomfortable just visiting. When that steel door shuts it is pretty spooky.

He'll get all the cooperation he needs from any politician he talks
To because he's not a GI. Ow if OTOH he were a member of the military on a trumped up charge, it would be a different story. He would be just left to rot.

Pretty sad when so many supposedly American officials loathe the military to that level.

Was it done maliciously? It was an accident. I would not sure until I had some knowledge that someone purposely locked me up. Medical bills, sure.

This is just silly. Pols go out of their way to defer to vets. (nothing wrong with that).

Definitely weird. If it was a prank going south, sure. At the first reading this it does sound like an accident where u said take a left and you took a right or I said left instead of right. I really don't like to penalize for innocent mistakes myself. Just lesson learned and make sure it doesn't happen again. OTOH, I'd hang them high if they had a habit of doing such things

Doesn't matter if it's the first time or the 40th time.

It's a potential accidental death waiting to happen.

How about if we sequester the Chief of Police or the Mayor of Chicago there for 31 hours?

Ya think Rahm Immanuel would say, " Well accidents happen. It's cool."

Nope, he'd hang 'em high.

The visit was official jail business, Farad Polk was inside. The wonderment issues is about why they didn't try to locate him. They don't keep track of visitors? At some point he had to be considered missing? No search?

Accident is the term often used to shield an incompetent who's pleads ignorance. How does someone entering a prison get lost for 31 hours without every inch of the prison being searched?

His treatment was deliberate and inhumane and the only reason that he's able to sue is because the people who did this to him are protected by the establishment, who would rather use the public's tax money settle grievances then to fire the idiots that think that they can get away with doing this. The people who do this know that they'll be protected which is why they think they can.

If you are a Statist who practices the religion of Statism (worshiping the so-called "State"), then you have a delimma on your hands. You're either all in or all out, black or white, all this or all that, certainly not BOTH (riding the fence). Which means this: If you are a true Statist, then you have to take the good, the bad and the ugly, ALL OF IT, HOOK, LINE AND SINKER. Be true to your school, you support the so-called "State" 188% even when it does wrong. Then go back to your cable television and a six pack of beer and try and forget about your moral dilemma.......

You are forgetting something, we are talking about government functionaries and their ability (inability?) to carry out their job functions.
