The point is that he could have died or suffered severe organ damage (due to thirst) after a few more days had he not been found. This kind of negligence is inexcusable and should be punished.

I don't normally go for suing the state on such things but this kind of stuff is weird. Guy could have died in there. Not sure how he broke the sprinkler off but absent that move, they might have found him from the stink about 8 days later.
That would be way weird to be entombed in a sound proof concrete chamber for 31 hours. Long enough to wonder if you're going to die in there.

I never practiced criminal law, but had to visit a client to get some papers signed. Due to miscommunication, I was (accidentally) trapped on an elevator for about five minutes, and that was more than enough for me.
I'm not sure what the damages should be, but I'm not about to argue with the reality of a claim. After all, part of the point of a legal judgment is also to teach the defendant not to do it again. |

Yeah, I am not big on such lawsuits either but this one should go ahead.
I once visited a neighbor who had been jailed for something he should not have IMHO. It was pretty uncomfortable just visiting. When that steel door shuts it is pretty spooky.

To because he's not a GI. Ow if OTOH he were a member of the military on a trumped up charge, it would be a different story. He would be just left to rot. Pretty sad when so many supposedly American officials loathe the military to that level.

Was it done maliciously? It was an accident. I would not sure until I had some knowledge that someone purposely locked me up. Medical bills, sure.

The visit was official jail business, Farad Polk was inside. The wonderment issues is about why they didn't try to locate him. They don't keep track of visitors? At some point he had to be considered missing? No search?
