Tire and Rim exchange gone wrong

It seems like Ive come across a true Art of the Deal con artist, to cut to the chase he bought a car of mine but didnt like the rims ,he noticed a set of ronals 16s I had on another car and wanted to do a swap out but wanted to put a new set of tires on .He said he would bring the other set back that evening, didnt happen .I call for a meet up thru VM ,he VMs me back and states his gotta go out of town on a family emergency .I state ,leave them at a friends house ,Ill meet up and get them from friend. No call back ,no text ,no email . In this town it pays to be untrusting ,real untrusting.

Sorry that happened. I suggest just doing business in a businesslike manner.....IOW, give the product when it is paid for. I'm not being unfriendly, just being businesslike.

Many years ago we sold a 63 Buick to someone my wife worked with. The price was all of $300 (that was a long time ago). He showed up with only $150 in his wallet, said he'd give the rest to my wife on monday. He promptly drove the car into a street lamp. He never paid the remainder because...wait for it... The car was a wreck.

There is a guy near here, one of my nearest neighbors about 2 miles down the road. I used to help him with his junk computers. I finally sold him one of my old boxes to help update his life.

Not much money. A mere fraction of its value, and far less expensive than any of his junk.

He never paid. Not even a cent. He avoids me, like in town at a gas station or what not.

Best money I never got

I have honestly NEVER had anything like that work out. Whether it be for the car dealership when I financed someone, car repairs on payments, or just straight out loans. NEVER was made whole... EVER.

Always some excuse as to why they can't pay. Always always. With the cars, they've always been cheap vehicles, and their down payment covers or almost covers what I had into them, but I've found after 3 failed attempts to do buy here pay here that it's not worth it. I totally respect the dealers who do this and totally understand why they charge $10,000 for a $1,000 car at 29.999% interest.

The worst one was a very skilled auto body guy I let set up in my back garage at the old dealership. I let him buy and sell a few cars on my license, and paid good money for him to do several repairs on my vehicles. He did really well for a year. When I made the choice to close the dealership, I helped him find a new place, get all set up, sold him some equipment on loan and paid for the sales tax on vehicles he had left to sell. The agreement was when he sold one of his cars he would pay me off.

He called me about a month after closing saying he sold a truck (worth about $5000, he owed me less than a grand) and that he needed help with the title work. I agreed and said we can meet and I'll help with the title and he can pay me off. The next day he texted saying he went to a title service place that helped him. I asked when he was going to pay me off. No response. Tried contacting him several times throughout the next few months, he obviously avoided me.

What the dummy didn't realize is I would have still given him lots of work and I would recommend him to everybody I knew. After everything I did for him as well. Just shocking, highly stupid.

In a discussion with my attorney about a similar thought he said "Tom if you are going to run a business you need to do it in a businesslike manner."

Do it right and there will be no hard feelings. In deals gone bad you not only lose the money you lose the customer and or the friend.

Maybe I'm jaded but I never do favors for anyone unless they are a close friend.

Lend money? Heck no. In Tyler's case I'd go right to his new shop and reposes something worth the money he owes me. Or I'd be knocking on his front door seven days a week asking about my money. Sure I'll sell you equipment on credit just give me title to one of those vehicles, with a key...

The last nice thing I did was pick up a hot water heater on my account for $600 for another local builder who I have known for years. He didn't want to pay me so I knocked on his beach house door every morning until he did. Finally he did when I said either you pay me or I'm going to your job and cutting the heater out. Scum bag, no more favors.

I did stop by a few times. He's not there much during the day.

I've got better things to do than stalk someone over $700. He's lost 10x that amount in lost business from screwing me.

Finally ,finally got the rims back after 3 weeks, after dodging my calls which I made daily at the same time of 7 am he unknowingly picks up my call and says he will be in the area that day and will drop off ,I ask for a photo sent when done since I cant be their and will not reschedule due to his behavior,he agrees ,done done done .He asked about buying the 5spd out of another car but Ive lost interest in working with people who cant keep their word for one ,and slack response when being polite to complete their side of a bargain .

I've been the "I"ll get you the rest tomorrow" guy on CL a few times in college. Taking a pic of state ID and confirming the address on the ID usually makes everyone happy.

I have a motto that I refer to when selling a car:

"Cash or cashier's check. No exceptions."

It's better to lose a buyer than lose your money.

Very interesting thread. Loosely along these lines:

I have done all kinds of different things for people over the years. I have learned that discounting a price is not a good modus operandi. I either do things for full price or for free. Discounting the price results in people considering you to be cheap labor. What I have happily learned over the years is that doing things for free will more often than not, bring more in return than the job was worth.

From what I have seen on the various People's Court type shows is that any sort of business transactions needs to be cleraly written down and signed for.
That way you have legal proof to recover something if there is a default.

When you are the one paying and are paying some sort of payment ore even an exchange of goods or work you need to get something it writing that you paid.
